Ord 92-130 ORDINANCE NO. 92-130 AN ORDINANCE OF THE CITY COUNCIL OF FEDERAL WAY, WASHINGTON, APPROVING THE KING COUNTY FIRE PROTECTION DISTRICT NO. 39 LONG RANGE PLAN AND AMENDING FEDERAL WAY CODE TITLE 20.230 (ORDINANCE NO. 90-40, 91-109, AND 91- 114) TO ADOPT THE KING COUNTY FIRE PROTECTION DISTRICT NO. 39 LONG RANGE PLAN AS A CITY OF FEDERAL WAY SEPA POLICY. WHEREAS, the King County Fire Protection District No. 39 Long Range Plan is consistent with the City of Federal Way's existing land use policies contained in the Comprehensive Land Use Plan, the Federal Way Zoning Code and Zoning Map; and WHEREAS, the King County Fire Protection District No. 39 Long Range Plan is consistent with the Growth Management Act as it contains the following components: (A) an inventory showing the location and capacity of existing capital facilities; (B) a forecast of future needs per capital facilities; (C) the location and capacity of proposed new or expanded capital facilities; (D) a six-year capital improvement plan identifying sources of public money to fund these improvement; and (E) the need for consistency in coordination between the land use element, capital facilities element and financing plan; and WHEREAS, approval of the King County Fire Protection District No. 39 Long Range Plan will allow the city to use the Plan as a basis for ongoing coordination with regard to proposed amendments to the City's Comprehensive Land Use Plan; and WHEREAS, a Determination of Non-significance under SEPA was issued for the Plan on December 13, 1991, and COpy WHEREAS, the King County Fire Protection District No. 39 Long Range Plan constitutes an appropriate basis for the exercise of substantive SEPA authority by the City of Federal Way, pursuant to RCW 43.21C.060; and WHEREAS, the formal designation of agency SEPA policies does not require environmental review and are categorically exempt as a procedural action under WAC 197-11-800 (20); WHEREAS, a public hearing was held on the proposed plan on January 22, 1992, before the Federal Way Planning commission, and WHEREAS, at the conclusion of the public hearing, the Planning commission evaluated the King county Fire Protection District No. 39 Long Range Plan for compliance with the Growth Management Act, and found it to be in compliance, and WHEREAS, the Planning commission recommends City council approval of the Plan, NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, DO ORDAIN AS FOLLOWS: section 1. The City Council makes the following Findings with respect to the King County Fire Protection District No. 39 Long Range Plan: A. The Fire Plan is consistent with the city of Federal Way Comprehensive Plan. The Fire Plan and the city's Comprehensive Land Use Plan both use PSCOG population forecasts as a basis for planning. Policies contained in - 2 - D. the Fire the Plan found to be consistent with are Comprehensive Land Use Plan. B. The Fire Plan is fully consistent with the Federal Way Zoning Code, including those adopted by reference from the Comprehensive Plan. There is internal consistency between the Fire Plan, Federal Way Zoning Code, and the Federal Way Comprehensive Plan. C. The approval Fire of the Plan bears a substantial relation to public health, safety, and welfare. Approval of the Fire Plan will allow the City to ensure cost efficient, timely, and adequate service to the City and surrounding incorporated areas provided that unsecured funding sources, including a bond issue, impact fees, benefit charge, excess levy, and the lifting of the 106% property tax lid, are approved by the citizens of Federal Way. The Fire Plan is consistent with the Growth Management Act. The Fire Plan fully satisfies these informational requirements for a capital facilities plan as defined by the Growth Management Act, as it contains the following components: 1. An inventory showing the location and capacity of existing capital facilities. 2. A forecast of future needs for capital facilities. 3. The location or capacity and of proposed new expanded capital facilities. - 3 - 4. A six-year capital improvement plan identifying sources of public money to fund these improvements. 5. The need for consistency and coordination between the land use element, capital facilities element, and financing plan. E. Approval of the Fire Plan will allow the city to use the Fire Plan as a basis for ongoing coordination with regard to piecing together the city of Federal Way Capital Facilities Plan. F. Approval of the Fire Plan will allow the city to make progress in preparing and adopting an impact fee ordinance for fire protection facilities. Section 2. The King County Fire Protection District No. 39 Long Range Plan of the City of Federal Way is hereby approved. section 3. The City of Federal Way Code Title 20, Environmental Policy, section 20.230, (Ordinance No. 90-40 and Ordinance No. 91-109), is amended as follows: 20.230 SEPA - Policies .10 The policies and goals set forth in this chapter are supplementary to those in the existing authorization of the City. .20 The city designates and adopts by reference the following policies as the basis for the city's exercise of authority under this chapter: A. The city shall use all practicable means, consistent with other essential considerations of state policy, to improve and coordinate plans, functions, programs, and resources to the end that the state and its citizens may: - 4 - C. (5) (6) (7) (1) Fulfill the responsibilities of each generation as trustee of the environment for succeeding generations; (2 ) Assure for all people of Washington safe, healthful, productive, and aesthetically and culturally pleasing surroundings; (3) Attain the widest range of beneficial uses of the environment without degradation, risk to health or safety or other undesirable and unintended consequences; (4) Preserve important historic, cultural, and natural aspects of our national heritage; Maintain, wherever possible, an environment which supports diversity and variety of individual choice; Achieve a balance between population and resource use which will permit high standards of living and a wide sharing of life's amenities; and Enhance the quality of renewable resources and approach the maximum attainable recycling of depletable resources. The City recognizes that each person has a fundamental and inalienable right to a healthful environment and that each person has a responsibility to contribute to the preservation and enhancement of the environment. B. The City adopts by reference the following city codes, ordinances, resolutions, plans and policies as now exist or as may hereinafter be amended: (1) (2) (3 ) The Federal Way Comprehensive Plan. Severability. If any section, subsection, clause or phrase of the sections herein are for any reason held to be invalid or unconstitutional, or unconstitutionality shall such invalidity not validity or affect the constitutionality of the remaining portions of the chapter. section 5. Effective Date. This ordinance shall be effective five (5) days after passage and publication of an approved summary consisting of the title hereto.
