ORDINANCE NO.
92-131
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF FEDERAL WAY, WASHINGTON, ADDING A SECTION
TO THE CITY TRAFFIC CODE, ORDINANCE 91-91,
AUTHORIZING THE ADMISSIBILITY OF BLOOD OR
BREATH REFUSALS IN DWI AND PHYSICAL CONTROL
CASES.
WHEREAS,
the Federal Way City Council has enacted a
Traffic Code in Ordinance 91-91 which adopts the Model Traffic
ordinance, RCW 46.90, by reference; and
WHEREAS, the Federal Way city Council further enacted
specific sections in Ordinance 91-91 dealing with Driving While
Under the Influence and Actual Physical Control While Under the
Influence; and
WHEREAS, the City Council finds that persons who drive
while under the influence of alcohol or intoxicants represent a
serious hazards to the citizens of Federal Way; and
WHEREAS,
the
City
Council
finds
that
the
immediate
passage of this ordinance will ensure continued enforcement of DWI
laws within the city of Federal Way; and
WHEREAS,
the
interest
of
public
health,
safety
and
welfare in preventing the hazards of DWI warrants emergency passage
of this ordinance; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON,
DOES HEREBY ORDAIN AS FOLLOWS:
section 1.
Federal Way Ordinance 91-91 is hereby amended
to add a new section as follows:

Severabilitv.
If any section,
sentence,
clause or phrase of this ordinance should be held to be invalid or
unconstitutional
by
a
court
of
competent
jurisdiction,
such
invalidity or unconstitutionality shall not affect the validity or
constitutionality of any other section, sentence, clause or phrase
of this ordinance.
section 3.
Effective Date.
This emergency ordinance
shall be effective immediately upon passage.
