AN ORDINANCE OF THE CITY OF FEDERAL WAY,
WASHINGTON, AMENDING ORDINANCE NO. 90-33,
ADOPTING THE 1991 EDITIONS OF THE WASHINGTON
STATE UNIFORM BUILDING CODE, UNIFORM PLUMBING
CODE, UNIFORM MECHANICAL CODE, UNIFORM FIRE
CODE, THE UNIFORM HOUSING CODE, UNIFORM SIGN
CODE, UNIFORM CODE FOR THE ABATEMENT OF
DANGEROUS BUILDINGS, UNIFORM SWIMMING POOL,
SPA AND HOT TUB CODE, AND ESTABLISHING AN
EFFECTIVE DATE OF JULY 1, 1992.
WHEREAS, the City of Federal Way is required to adopt the
state of Washington Uniform Building Code as amended by the state
Building Code Council pursuant to RCW 19.27.031; and
WHEREAS, the city has determined that it is necessary to
protect the public health, safety and welfare by adopting the 1991
updated editions of the Uniform Plumbing Code, Uniform Mechanical
Code, Uniform Fire Code, Uniform Housing Code, Uniform Sign Code,
Uniform Code for the Abatement of Dangerous Buildings, and the
Uniform Swimming Pool, Spa and Hot Tub Code.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL
WAY, WASHINGTON, DOES ORDAIN AS FOLLOWS:
section 1.
Ordinance No. 90-33, section 4 is amended as
follows:
15.04.020 Purpose and conflicts. The purpose
of the codes and regulations adopted in this
title are to provide for, and promote, the
health, safety and welfare of the general
public, and not to create or otherwise
establish or designate any particular class or
group of persons who will or should be
especially protected by the terms of these
codes and regulations.
In case of conflict among the following codes,
the codes first numbered shall govern over
those following:

Ordinance No. 90-33, section 7, is amended as
follows:
15.08.010 Buildinq Code adopted. The Uniform
Building Code (UBC),H.s-& 1991 Edition,
including Appendix Chapters 11 (Agricultural
Buildings), 12, Division II (Requirements for
Group R, Division 4 Occupancies), 32 (Re-
roofing), 49 (Patio Covers), 55 (Membrane
structures), 70 (Excavation and Grading), and
the Uniform Building Code standards, H.s-& 1991
Edition, both as published by the
International Conference of Building Officials
and as adopted bv the State of Washinqton
pursuant to Chapter 51-20 of the Washinqton
Administrative Code are adopted by this
reference as if set forth in full, subject to
the amendments, additions or deletions set
forth in this title. Provided, the purpose of
this code is not to create or otherwise
establish or designate any particular class or
group of persons who will or should be
especially protected or benefited by the terms
of this code.

"15.08.140 UBC Section 2905(f) amended" is amended as follows:

Section 2905(f) Drainaqe. provisions shall be
made to control the drainage of surface water
around buildings.
Adequate provisions shall be made to insure
that under-floor spaces remain free of running
or standing water. As a minimum such drains
shall be installed around the perimeter of the
building at the footings. Additional drains
may be reauired in the under-floor space. The
drain pipes shall be of sufficient size to
adequately convey water to an approved
location, but shall be a minimum size of
4 inches. Provisions shall be made to prevent
the drainage system from becoming blocked with
soil. The Buildinq Official mav waive the
provisions of this section when soils appear
to adequatelv drain the site and no water will
stand or run under the buildina.

The Chapters of the Uniform Plumbing Code set
forth above are adopted by this reference as
if set forth in full subject to the
amendments, additions or deletions set forth
in this Title.
Provided further, the purpose of this code is
not to create or otherwise establish or
designate any particular class or group of
persons who will or should be especially
protected or benefited by the terms of this
code.
Section 14.

section 32, Subsection
"D", entitled "15.10.060 Dangerous and insanitary construction" is
amended as follows:
D.
When any plumbing system is determined to
be insanitary and in violation of any
notice issued pursuant to the provision
of this Chapter, the Building Off icial
shall institute an abatement as
prescribed by Chapter 15.20 ef the
Uniform Code for the Abatement of
Danqerous Buildinqs as adopted bv the
citv of Federal Way !æRieipal Cede.
Section 15.
Ordinance No 90-33,
Section 33, entitled
"15.10.070 Violation of Code" is amended
as follows:
15.10.070 Violations of Code. The issuance or granting
of a permit or approval of plans and specifications shall
not be deemed or construed to be a permit for, or an
approval of, any violation of any of the provisions of
this code. No permit presuming to give authority to
-violate or cancel the provisions of this code shall be
valid, except insofar as the work or use which it
authorized is lawful.
The issuance or granting of a permit or approval of plans
shall not prevent the Building Official from thereafter
requiring the correction of errors in the plans and
specifications or from preventing construction operations

from being carried on when in violation of this or any
other provision of the Federal Way Municipal Code or from
revoking any certificate of approval when issued in
error.
Every permit issued by the Building Official
under the provisions of the code shall expire
by limitation and become null and void if the
work authorized for such permit is not
commenced within one hundred and ~ eiqhtv
fH-Gt lJJ!.Ql days. Before such work can be
recommenced, a new permit shall be first
obtained and the fee therefor shall be one-
half the amount required for a new permit for
such work provided no changes have been made,
or will be made in the original plans and
specifications; and provided further, that
such suspension or abandonment has not
exceeded one (1) year. EXCEPTION: Plumbing
permits for R-3 and M occupancies shall expire
one (1) year from the date of issue. Plumbing
permits may be renewed for one-half (1/2) of
the amount of the original permit fee for the
first permit issued for such work.

in writing to designate smoking and non-
smoking areas and to post those areas
with appropriate signs as defined and
required in Title 70 RCW as it relates to
the Washington Clean Air Act.

telephone numbers is prohibited.
Individuals, agencies or companies may
use the special telephone line for
automatic notification when approved by
the Fire Chief. This provision
specifically includes devices utilizing
the public telephone system.

Severabilitv.
If any section, sentence,
clause or phrase of this ordinance should be held to be invalid or
unconstitutional
by
a
court
of
competent
jurisdiction,
such
invalidity or unconstitutionality shall not affect the validity or
constitutionality of any other section, sentence, clause or phrase
of this ordinance.

Effective Date.
This ordinance shall be
effective July 1,1992, which shall be after publication of an
approved summary consisting of the title hereto.
