Ord 92-143 ORDINANCE NO. 92-143 AN ORDINANCE OF THE CITY OF FEDERAL WAY, WASHINGTON, AMENDING ORDINANCE NO. 90-33, ADOPTING THE 1991 EDITIONS OF THE WASHINGTON STATE UNIFORM BUILDING CODE, UNIFORM PLUMBING CODE, UNIFORM MECHANICAL CODE, UNIFORM FIRE CODE, THE UNIFORM HOUSING CODE, UNIFORM SIGN CODE, UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS, UNIFORM SWIMMING POOL, SPA AND HOT TUB CODE, AND ESTABLISHING AN EFFECTIVE DATE OF JULY 1, 1992. WHEREAS, the City of Federal Way is required to adopt the state of Washington Uniform Building Code as amended by the state Building Code Council pursuant to RCW 19.27.031; and WHEREAS, the city has determined that it is necessary to protect the public health, safety and welfare by adopting the 1991 updated editions of the Uniform Plumbing Code, Uniform Mechanical Code, Uniform Fire Code, Uniform Housing Code, Uniform Sign Code, Uniform Code for the Abatement of Dangerous Buildings, and the Uniform Swimming Pool, Spa and Hot Tub Code. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, DOES ORDAIN AS FOLLOWS: section 1. Ordinance No. 90-33, section 4 is amended as follows: 15.04.020 Purpose and conflicts. The purpose of the codes and regulations adopted in this title are to provide for, and promote, the health, safety and welfare of the general public, and not to create or otherwise establish or designate any particular class or group of persons who will or should be especially protected by the terms of these codes and regulations. In case of conflict among the following codes, the codes first numbered shall govern over those following: 1. Uniform Building Edition; Uniform Mechanical Edition; Code,~1991 2. Code,~1991 COpy 3. Uniform Edition; Uniform Edition; Fire Code,-l-9-8-8-1991 4. Plumbing Code,H.s-&1991 Section 2. Ordinance No. 90-33, section 7, is amended as follows: 15.08.010 Buildinq Code adopted. The Uniform Building Code (UBC),H.s-& 1991 Edition, including Appendix Chapters 11 (Agricultural Buildings), 12, Division II (Requirements for Group R, Division 4 Occupancies), 32 (Re- roofing), 49 (Patio Covers), 55 (Membrane structures), 70 (Excavation and Grading), and the Uniform Building Code standards, H.s-& 1991 Edition, both as published by the International Conference of Building Officials and as adopted bv the State of Washinqton pursuant to Chapter 51-20 of the Washinqton Administrative Code are adopted by this reference as if set forth in full, subject to the amendments, additions or deletions set forth in this title. Provided, the purpose of this code is not to create or otherwise establish or designate any particular class or group of persons who will or should be especially protected or benefited by the terms of this code. section 3. Ordinance No 90-33, Section 13, entitled "15.08.070 UBC section 307(a) amended" is deleted in its entirety. Section 4. Ordinance No 90-33, section 14, entitled "15.08.080 UBC section 702(b) amended" is deleted in its entirety. section 5. Ordinance No 90-33, Section 16, entitled "15.08.100 UBC section 1807 amended" is deleted in its entirety. section 6. Ordinance No 90-33, section 17, entitled "15.08.110 UBC section 1807(a) amended" is deleted in its entirety. section 7. Ordinance No 90-33, section 18, entitled "15.08.120 UBC section 1807(g) amended" is deleted in its entirety. Section 8. Ordinance No 90-33, Section 19, entitled "15.08.130 UBC section 1907 amended" is deleted in its entirety. section 9. Ordinance No 90-33, Section 20, entitled "15.08.140 UBC Section 2905(f) amended" is amended as follows: - 2 - Section 2905(f) Drainaqe. provisions shall be made to control the drainage of surface water around buildings. Adequate provisions shall be made to insure that under-floor spaces remain free of running or standing water. As a minimum such drains shall be installed around the perimeter of the building at the footings. Additional drains may be reauired in the under-floor space. The drain pipes shall be of sufficient size to adequately convey water to an approved location, but shall be a minimum size of 4 inches. Provisions shall be made to prevent the drainage system from becoming blocked with soil. The Buildinq Official mav waive the provisions of this section when soils appear to adequatelv drain the site and no water will stand or run under the buildina. section 10. Ordinance No 90-33, section 21, entitled "15.08.150 UBC Section 3202 amended" is deleted in its entirety. section 11. Ordinance No 90-33, section 23, entitled "15.08.170 UBC section 3805(b) amended" is deleted in its entirety. section 12. Ordinance No 90-33, section 25, entitled "15.08.190 UBC Chapter 57 added" is deleted in its entirety. section 13. Ordinance No. 90-33, section 27 is amended as follows: Plumbinq Code Adopted. That Chapters 11 and 12 are not adopted: PROVIDED FURTHER. That those reauirements of the Uniform Plumbinq Code relatinq to the ventinq of appliances as found in Chapter 13 are not adopted. The Chapters of the Uniform Plumbing Code set forth above are adopted by this reference as if set forth in full subject to the amendments, additions or deletions set forth in this Title. Provided further, the purpose of this code is not to create or otherwise establish or designate any particular class or group of persons who will or should be especially protected or benefited by the terms of this code. Section 14. Ordinance No 90-33, section 32, Subsection "D", entitled "15.10.060 Dangerous and insanitary construction" is amended as follows: D. When any plumbing system is determined to be insanitary and in violation of any notice issued pursuant to the provision of this Chapter, the Building Off icial shall institute an abatement as prescribed by Chapter 15.20 ef the Uniform Code for the Abatement of Danqerous Buildinqs as adopted bv the citv of Federal Way !æRieipal Cede. Section 15. Ordinance No 90-33, Section 33, entitled "15.10.070 Violation of Code" is amended as follows: 15.10.070 Violations of Code. The issuance or granting of a permit or approval of plans and specifications shall not be deemed or construed to be a permit for, or an approval of, any violation of any of the provisions of this code. No permit presuming to give authority to -violate or cancel the provisions of this code shall be valid, except insofar as the work or use which it authorized is lawful. The issuance or granting of a permit or approval of plans shall not prevent the Building Official from thereafter requiring the correction of errors in the plans and specifications or from preventing construction operations - 4 - from being carried on when in violation of this or any other provision of the Federal Way Municipal Code or from revoking any certificate of approval when issued in error. Every permit issued by the Building Official under the provisions of the code shall expire by limitation and become null and void if the work authorized for such permit is not commenced within one hundred and ~ eiqhtv fH-Gt lJJ!.Ql days. Before such work can be recommenced, a new permit shall be first obtained and the fee therefor shall be one- half the amount required for a new permit for such work provided no changes have been made, or will be made in the original plans and specifications; and provided further, that such suspension or abandonment has not exceeded one (1) year. EXCEPTION: Plumbing permits for R-3 and M occupancies shall expire one (1) year from the date of issue. Plumbing permits may be renewed for one-half (1/2) of the amount of the original permit fee for the first permit issued for such work. section 16. Ordinance No 90-33, section 34, Paragraph "D", entitled "15.10.080 Permit required" is deleted in its entirety. section 17. Ordinance No 90-33, section 35, entitled "15.10.090 Work not requiring a permit" is deleted in its entirety. section 18. Ordinance No 90-33, section 37, entitled "15.10.110 Application for permit" is deleted in its entirety. section 19. Ordinance No 90-33, section 39, entitled "15.10.130 UPC section 401(a) amended" is deleted in its entirety. section 20. Ordinance No 90-33, section 40, entitled "15.10.140 UPC section 503(a) amended" is deleted in its entirety. section 21. Ordinance No 90-33, section 41, entitled "15.10.150 UPC section 1007(f) amended" is deleted in its entirety. - 5 - Section 22. Ordinance No 90-33, Section 47, entitled "15.12.010 Mechanical Code adopted" is amended as follows: 15.12.010 Mechanical Code adopted. The Uniform Mechanical Code (UMC) , ~ 1991 Edition, including Appendix Chapter 22 Fuel- Gas Piping, as published by the International Conference of Building Officials and the International Association of Plumbing and Mechanical Officials, and as adoDted by the State of Washinqton pursuant to Chapter 51-22 of the Washinqton Administrative Code is adopted by this reference as if set forth in full, subject to the amendments, additions or deletions set forth in this title. Provided, the purpose of this code is not to create or otherwise establish or designate any particular class or group of persons who will or should be especially protected or benefited by the terms of this code. section 23. Ordinance No 90-33, section 51, entitled "15.14.010 Fire Code adopted" is amended as follows: 15.14.010 Fire Code adopted. The Uniform Fire Code (UFC), ~ 1991 Edition, excluding Article 78 (Fireworks), and including Appendix Chapters lIB (Protection of Flammable and Combustible Liquids in Locations Subject to Flooding), II C (UariRas) and II Ð (Rifle RaR§"es) III-B (Fire Hvdrant Locations). and III-C (Testinq Automatic Sprinkler and Standpipe Svstems) .as published bv the International Conference of Buildinq Officials and the Western Fire Chiefs Association. and as adopted bv the state of Washinqton Dursuant to Chapter 51-24 of the Washinqton Administrative Code is adopted by this reference as if set forth in full, subject to the amendments, additions or deletions set forth in this title. Provided, the purpose of this code is not to create or otherwise establish or designate any particular class or group of persons who will or should be especially protected or benefited by the terms of this code. Section 24. Ordinance No 90-33, Section 53, entitled "15.14.030 UFC Section 10.309(d) amended" is deleted in its entirety. - 6 - section 25. Ordinance No 90-33, section 54, entitled "15.14.040 UFC section 11.101 (a) amended" is deleted in its entirety. Section 26. Ordinance No 90-33, section 55, entitled "15.14.050 UFC section 11.101 (b) amended" is deleted in its entirety. Section 27. There is hereby created a new section 15.08.055 UFC section 11.203 amended of the Federal Way Municipal Code to read as follows: 15.08.055 UFC Section 11.203 amended. Section 11.203 of the Uniform Fire Code is amended and supplemented to read as follows: Section 11.203 Open Burninq Prohibited. Open burning within the city limits of the City of Federal Way is prohibited. section 28. Ordinance No 90-33, section 56, entitled "15.14.060 UFC Section 13.103 amended" is amended as follows: 15.14.060 UFC section ~ 11.502(a) amended. section ~ 11.502(a) of the Uniform Fire Code is amended and supplemented thereto by the addition of a new paragraph to read as follows: The Fire Chief is empowered and authorized to order the owner or occupant in writing to designate smoking and non- smoking areas and to post those areas with appropriate signs as defined and required in Title 70 RCW as it relates to the Washington Clean Air Act. section 29. Ordinance No 90-33, section 57, entitled "15.14.070 UFC section 14.107 amended" is amended as follows: 15.14.070 UFC section ~ 14.109 amended. section ~ 14.109 of the Uniform Fire Code .is amended to read as follows: The installation or use of any electric, electronic or mechanical alarm device which gives automatic notice to the - 7 - communications center of the Federal Way Fire Department on emergency or business telephone numbers is prohibited. Individuals, agencies or companies may use the special telephone line for automatic notification when approved by the Fire Chief. This provision specifically includes devices utilizing the public telephone system. section 30. Ordinance No 90-33, section 58, entitled "15.14.050 UFC section 25.101 deleted" is deleted in its entirety. section 31. Ordinance No 90-33, section 59, entitled "15.14.090 UFC Section 77.106(b) amended" is amended as follows: 15.14.090 UFC section 77.106(13) 77.107(a) amended. Section 77.186(13) 77.107(a) of the Uniform Fire Code is amended to read as follows: The storage of explosives and blasting agents within the city is prohibited. EXCEPTION: The Fire Chief may issue a special permit for such storage when it appears in his or her judgment there will be no undue danger to persons or property. section 32. Ordinance No 90-33, section 74, entitled "15.18.010 Housing code adopted" is amended as follows: 15.18.010 Housinq code adopted. The Uniform Housing Code (URC) , H&& lln Edition, as published by the International Conference of Building Officials, is adopted by this reference as if set forth in full, subject to the amendments, additions or deletions set forth in this Chapter. Provided, the purpose of this code is not to create or otherwise establish or designate any particular class or group of persons who will or should be especially protected or benefited by the terms of this code. section 33. Ordinance No 90-33, section 77, entitled "15.20.010 Sign code adopted" is amended as follows: 15.20.010 Siqn code adopted. Sign Code (URC) , H&& 1991 The Uniform Edition, as - 8 - published by the International Conference of Building Officials, is adopted by this reference as if set forth in full, subject to the amendments, additions or deletions set forth in this Chapter. Provided, the purpose of this code is not to create or otherwise establish or designate any particular class or group of persons who will or should be especially protected or benefited by the terms of this code. section 34. Ordinance No 90-33, section 81, entitled "15.22.010 Code for the Abatement of Dangerous Buildings adopted" is amended as follows: 15.22.010 Code for the Abatement of Danqerous Buildinqs adopted. The Uniform Code for the Abatement of Dangerous Buildings (UCADB) , ~ 1991 Edition, as published by the International Conference of Building Officials, is adopted by this reference as if set forth in full, subject to the amendments, additions or deletions set forth in this Chapter. Provided, the purpose of this code is not to create or otherwise establish or designate any particular class or group of persons who will or should be especially protected or benefited by the terms of this code. section 35. Ordinance No 90-33, section 88, entitled "15.24.010 Swimming Pool, Spa and Hot Tub Code adopted" is amended as follows: 15.24.010 Swimminq Pool. Spa and Hot Tub Code adopted. The Uniform Swimming Pool, Spa and Hot Tub Code, ~ 1991 Edition, as published by the International CeRferenee ef Blii1àinIJ Offieials Association of Plumbinq and Mechanical Officials, is adopted by this reference as if set forth in full, subject to the amendments, additions or deletions set forth in this title. Ordinance No 90-33, Section 90, entitled "15.26.010 Regulations for Barrier-Free Facilities adopted" is deleted in its entirety. Section 37. Severabilitv. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this ordinance. section 38. Effective Date. This ordinance shall be effective July 1,1992, which shall be after publication of an approved summary consisting of the title hereto.
