92-145
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF FEDERAL WAY, WASHINGTON, GRANTING TO THE
PUBLIC WORKS DIRECTOR THE AUTHORITY TO
ESTABLISH TEMPORARY REDUCTIONS TO SPEED LIMITS
TO THE CITY'S STREETS AND HIGHWAYS (AMENDING
ORDINANCE NO. 90-29).
WHEREAS, the City Council of the City of Federal Way has
previously adopted Ordinance No.
90-29 which established speed
limits for the City's roadways, streets and highways by adopting
the State traffic laws regulating the speed of vehicles and by
establishing speed limits of streets that are to be considered
exceptions to the State laws; and
WHEREAS,
the
City
Council
recognizes
that
certain
temporary circumstances may require a temporary reduction to the
established speed limits of the city's streets,
highways or a portion thereof; and
roadways and
WHEREAS,
granting to the Public Works
Director the
authority
to
establish
temporary
reductions
to
speed
limits
improves the efficiency and responsiveness to relieve temporary
traffic problems;
NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON,
DOES HEREBY ORDAIN AS FOLLOWS:
Section 1.
A new section 7 is added to Ordinance No.
90-29 as follows:
Section 7.
Temporarv Decreases to State Speed
Limits.
Whenever it is deemed unadvisable for vehicles to operate
at the maximum speed limit allowed bv State law in anv portion of

a street or public hiqhwav on account of temporarv conditions.
includinq. but not limited to. hiqhwav construction or repairs.
identified excessive traffic periods.
anv danqerous condition.
durinq anv emerqencv period. whether man-made or natural disaster.
or anv other temporarv cause. the Public Works Director of the
citv. subiect to the approval of the state Hiqhwav Commission in
cases involvinq state hiqhwavs. shall determine and fix the lower
maximum speed limits or otherwise requlate a lesser speed: provided
that. in no case shall the maximum speed be reduced to less than 20
miles per hour.
In all such cases. the Public Works Director shall
take steDs to ensure that adequate siqnaqe reflectinq the reduced
speed limits shall be maintained.
section 2.
The City Council of the City of Federal Way
specifically finds that there currently exists within the City of
Federal Way construction activity on Southwest 356th Street between
20th Avenue Southwest and Pacific Highway South, and that this
specific
construction
activity
is
a
basis
for
the
emergency
adoption of this general ordinance granting to the Public Works
Director the ability to establish temporary reductions to speed
limits, based upon certain circumstances.
The City Council of the
City of Federal Way specifically finds that this condition is
detrimental
to
the public health,
safety
and welfare
of
its
citizens upon which is the emergency adoption of this ordinance may
be properly based.
section 3.
This emergency ordinance shall be effective
as of the date of its passage, based upon the findings stated in
Section 2 herein.
