ORDINANCE NO. 93-178
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF FEDERAL WAY, WASHINGTON, AMENDING THE CITY
OF FEDERAL WAY CRIMINAL CODE TO ADD NEW
SECTIONS, PROHIBITING THE SALE OF TOBACCO
PRODUCTS TO MINORS. (AMENDS ORDINANCE 91-89
AND 91-106.)
WHEREAS,
the
Federal
Way
City
Council
finds
that
this
ordinance is in the interest of the public's health, safety and
welfare, now, therefore,
THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, DO
ORDAIN AS FOLLOWS:
section 1.
New Provisions. The Federal Way Criminal Code,
Chapter Six, Article III - "Crimes Relating to Children and Minors"
is amended to add new sections 6-64 and 6-65 as follows:
Sec. 6-6~.

The following state statute, including all future amendments

is
adopted
by
reference:

9.68A.090, Communicating with a minor for immoral purposes.

Sec. 6-62.
Contributing to the delinquency of a minor.
In all cases when any child is dependent or delinquent as
defined in RCW 13.34.030, any person who, by act or omission,
knowingly encourages, causes, or contributes to the dependency
or
delinquency
of
such
child,
shall
be
guilty
of
a
misdemeanor.

Sec. 6-63.
Leaving Children Unattended
It is unlawful for any person having the care, custody and/or
control of minor children under the age of eight years, to
leave such children in a parked automobile unattended by a
person over the age of
12
years,
which such vehicle
is
standing upon a street or alley or in a public place.
Every
person convicted of a violation of the provisions of this
section shall be guilty of leaving children unattended,
a
misdemeanor.

Sec. 6-64.
Acts Prohibited
No person shall sell or qive. or permit to be sold or qiven to
any person under the aqe of eiqhteen (18) years any ciqar.
ciqarette, ciqarette paper or wrapper or tobacco in any form.

Sec. 6-65.
Defenses
It shall be no defense to a prosecution for a violation of
section 64-4 that the Derson acted. or was believed bv the
defendant to act. as aqent or representative of another.
section 2.
Severability.
Should any section, subsection,
paragraph, sentence, clause or phrase of this ordinance, or its
application to a specific person or set of circumstances,
be
declared unconstitutional or invalid for any reason, such decision
shall not affect the validity of the remaining portion of this
ordinance,
or
its
application to any other person or
set of
circumstances.
section 3.
Effective Date.
This
ordinance
shall
be
effective thirty (30) days after passage as provided by law.
