ORDINANCE NO. 93-182
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF FEDERAL WAY, WASHINGTON, ADOPTING BY
REFERENCE THE STATE STATUTUES RELATING TO A
CIVIL SYSTEM OF DRUG FORFEITURE AND
ESTABLISHING A SCHEME FOR ADJUDICATION.
(Repeals Ordinance 93-179, sections 1-4)
WHEREAS, the City of Federal Way city Council finds that this
ordinance is in the interest of the public health, safety and
welfare; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, DOES
ORDAIN AS FOLLOWS:
section 1.
Repealer. Ordinance Number 93-179, sections 1,
2,3, and 4, are hereby repealed.
section 2.
Druq Forfeiture Procedure Adopted by Reference.
RCW 69.50.505,
including all
future additions,
deletions
and
amendments thereto, is hereby adopted by reference as Federal Way's
system of Drug Forfeitures.
section 3.
Hearinq.
RCW 69.50.505(e) is amended soley to
provide the specific exception that the Federal Way Chief of Police
shall designate a Hearings Examiner for forfeiture matters upon
concurrence of the city Manager.
section 4.
Definitions.
All terms used herein shall, in
addition to their ordinary meaning, also be defined according to
(1) State Statute Chapter 65.50 RCW,
(2) City Ordinance, or (3)
common law, in that order of preference.

Severability.
Should any section, subsection,
paragraph, sentence, clause or phrase of this ordinance, or its
application to a specif ic person or set of circumstances,
be
declared unconstitutional or invalid for any reason, such decision
shall not affect the validity of the remaining portion of this
ordinance,
or
its
application to any other person or set of
circumstances.
section 6.
Effective Date.
This
ordinance
shall
be
effective thirty (30) days after passage as provided by law.
