Ord 94-218 / ORDINANCE NO. 94-218 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, AMENDING ITS SOLID WASTE AND RECYCLING UTILITY SCHEDULE OF RATES AND RETAINAGES FOR SERVICE BY PROVIDING FOR AN 8.24% INCREASE IN THE COLLECTION RATES, BY THE ADDITION OF A TWENTY DOLLAR ($20.00) YARD WASTE CONTAINER RE-DELIVERY FEE, BY THE ADDITION OF AN AUTOMATIC PASS THROUGH OF ANY FUTURE DISPOSAL FEE INCREASES ASSESSED BY KING COUNTY FOR USE OF ITS DISPOSAL FACILITIES AND BY INCLUDING COMMERCIAL DROP BOX RATES FOR ROLL-OFF CONTAINERS (AMENDS PREVIOUS ORDINANCE 93-167). WHEREAS, the city previously adopted the King County Solid Waste Comprehensive Plan and adopted a related recycling program implementing a portion of that plan; and WHEREAS, the City participates in an Interlocal Agreement with King County for the development of a solid waste management plan for the collection and disposal of solid waste and recycling, and participates in the comprehensive King County Solid Waste Management Plan Council Resolution and Interlocal Agreement; and WHEREAS, the City is authorized to establish a system of collection for solid waste and recyclable and reusable materials, including the regulation of recycling centers by ordinance and award of franchise for residential and commercial collection of solid waste and recycling under the city's direction; and WHEREAS, on March 16, 1993, the City Council of the City of Federal Way adopted Ordinance 93-167 which established a Ord. # 94-218 , p. 1 COpy Schedule of Rates and Retainages for service provided as part of the City's solid waste and recycling utility; and WHEREAS, on June 23, 1994, the City Council Finance and Economic Development Committee considered the Solid Waste and Recycling Rate Review Final Report dated June 16, 1994, prepared by Perrin, McMillan & Miller ("Report"); and WHEREAS, the Report contained a recommendation that the City increase its collection rates, that the City pass through the costs of any future King County Solid Waste Division increases in tipping fees for use of King County Disposal Facilities, and that commercial drop box rates for roll-off containers be included in the City's rate schedule; and WHEREAS, on June 23, 1994, the City Council Finance and Economic Development Committee heard testimony recommending that the city add a $20.00 re-delivery fee to customers who return and then reorder a yard waste container within a twelve (12) month period to promote annual as opposed to seasonal usage of such recycling containers; and WHEREAS, on June 23, 1994, the City Council Finance and Economic Development Committee moved to forward the Report to the full city Council without a recommendation; and WHEREAS, on July 5, 1994, the full City Council considered the Report and heard testimony from City staff; and WHEREAS, on July 19, 1994, the City Council held a public hearing after all public notice as required by law on the proposed amendments to the city's solid waste and recycling Ord. # 94-2l8 , p. 2 utility Schedule of Rates and Retainages for Service; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Findinas. The City Council adopts by reference as if fully incorporated herein the findings contained in Ordinance 93-167 with respect to the establishment and operation of a solid waste and recycling utility, and the findings contained in the Report with respect to the need to increase collection rates by 8.24%, adding an automatic pass through of any future disposal tipping fee increases assessed by King County Solid Waste Division and including commercial drop box rates for roll-off containers in the rate schedule. The City Council further finds that the addition of a $20.00 re-delivery fee for yard waste containers will promote annual usage as opposed to seasonal usage of yard waste containers. section 2. Amendment. The rates for services mentioned in section 12 of Ordinance 93-167 titled "Rates and Retainages for Service" is amended to reference the new Exhibit A attached hereto and incorporated by reference. The rates for services schedule as contained in this Exhibit A, attached hereto and incorporated by reference, is hereby adopted as the amended charges to be paid to the City and as the schedule of retainages to be retained by the Franchisee for services rendered for each category contained in the schedule. Ord. # 94-218 , p. 3 section 3. Ratification. Any act consistent with the authority and prior to the effective date of this ordinance is hereby ratified and affirmed. Section 4. Severabilitv. The provisions of this ordinance are declared separate and severable, invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance or the invalidity of the application thereof to any person or circumstances shall not affect the validity of the remainder of the ordinance, or the validity of its application to other persons or circumstances. section 5. Rates for Commercial and Multi-Family Solid Waste and Recycling 1. Multi-family Solid Waste and Recycling Collection (Can Service) a. Solid Waste Only Existing complexes with curbside can service will be charged for each 32 gallon can collected. Each unit shall receive curbside service. The entire complex must subscribe at a rate of ~ ill per can per month. Of the rates collected, $+,-l4 LJ..Q is retained by the Franchisee and $0.36 is retained by the City. b. Solid Waste and Recyclables Existing complexes with curbside can service will be charged for solid waste and recycling pickup at each unit.
