Ord 95-247 ORDINANCE NO. 95-247 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, ADOPTING A PARKS, RECREATION AND OPEN SPACE PLAN (REPEALING, IN PART, ORDINANCE NO. 91-114, SECTIONS 1 AND 2). WHEREAS, the City Council desires to adopt a Parks, Recreation and Open Space Plan ("Plan") as authorized by Chapters 35A.63 and 36.70A, Revised Code of Washington; and WHEREAS, the Plan is consistent with the City of Federal Way's existing land use policies contained in the Comprehensive Land Use Plan, the Federal Way Zoning Code and Zoning Map; and WHEREAS, the Plan constitutes an appropriate basis for the exercise of substantive SEPA authority by the city of Federal Way, pursuant to RCW 43.21C.060; and WHEREAS, the Federal Way Parks Commission approved the - Plan at its August 3, 1995 meeting and recommended that it be forwarded to the City Council for approval; and WHEREAS, the Federal Way Planning Commission approved the Plan at its September 27, 1995 meeting and recommended that it be forwarded to the City Council for approval; and WHEREAS, the Parks and Recreation Committee of the Federal Way City Council approved the Plan at its October 23, 1995 meeting and recommended that it be forwarded to the full city Council for approval; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS: ORD # 95-247 , PAGE 1 COpy Section 1. Parks. Recreation and Ocen Scace Plan Adoction. The City of Federal Way Parks, Recreation and Open Space Plan, a copy of which is on file with the Office of the City Clerk, which document is hereby incorporated by this reference as if set forth in full, is hereby adopted pursuant to the authority granted by chapters 35A.63 and 36.70A, Revised Code of Washington. section 2. Receal. Ordinance No. 91-114, sections 1 and 2, adopting the City's prior Comprehensive Parks, Recreation and Open Space Plan ("Prior Plan") as well as its associated elements, are hereby repealed in their entirety. section 3. Pendinq Actions. Repeal of the City's Prior Plan pursuant to section 2 of this ordinance shall have no effect on, nor shall it invalidate, any action or pending action taken with regard to the Prior Plan prior to the effective date of this ordinance. Section 4. Severabilitv. The provisions of this - ordinance are declared separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section, or portion of this ordinance or the invalidity of the application thereof to any person or circumstance, shall not affect the validity of the remainder of the ordinance, or the validity of its application to other persons or circumstances. section 5. Savinqs Clause. Sections 1 and 2 of Ordinance No. 91-114, which are repealed by this ordinance, shall remain in force and effect until the effective date of this ordinance. In the event all or any part of the Plan is ORD # 95-247 , PAGE 2 subsequently challenged and invalidated in any manner, the Prior Plan shall remain in full force and effect. Section 6. Ratification. Any act consistent with the authority and prior to the effective date of this ordinance is hereby ratified and affirmed. section 7. Effective Date.
