Ord 95-246 I ORDINANCE NO. 95-~ AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, ADOPTING A COMPREHENSIVE SURFACE WATER MANAGEMENT PLAN WHEREAS, pursuant to Federal Way Ordinance No. 90-32, the city of Federal Way has established a Surface Water Management utility in order to promote the public health, safety and welfare by minimizing uncontrolled stormwater and sedimentation, to preserve and utilize the many values of the city's natural drainage system including water quality, open space, fish and wildlife habitat, recreation, education and urban separation and drainage and erosion control facilities, and to provide for the comprehensive management and administration of surface and stormwater; and WHEREAS, the City of Federal Way's Comprehensive Plan policies call for the development of surface water management plans and programs supporting the Comprehensive Plan goals; and WHEREAS, this Comprehensive Surface Water Management Plan ("Plan") constitutes an appropriate basis for the exercise of substantive SEPA authority by the City of Federal Way, pursuant to RCW 43.21C.O60; and WHEREAS, the puget Sound Water Quality Management Plan calls for the City to develop a comprehensive surface water management program; and ORD # 95-~ , PAGE 1 COP,. WHEREAS, the Planning Commission held public hearings on the Comprehensive Plan, including the Plan, on July 12, 19 and 26, 1995, August 2, 8, 9, 16, 23 and 30, 1995, and september 6 and 13, 1995, following which, on September 27, 1995, it approved and recommended adoption of the Comprehensive Plan and the Plan; and WHEREAS, the Land Use and Transportation Committee of the Federal Way city Council conducted public hearings consisting of special meetings of the whole City Council on the Comprehensive Plan, including the Plan on October 9 and 10, 1995 following which it recommended adoption of the comprehensive Plan and the Plan; and WHEREAS, the City Council desires to adopt the Plan as authorized by RCW 35A.63; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS: section 1. Comcrehensive Surface Water Manaqement Plan Adoption. The City of Federal Way Comprehensive Surface Water Management Plan, a copy of which is on file with the Office of the City clerk, which document is hereby incorporated by this reference as if set forth in full, is hereby adopted pursuant to the authority granted by RCW 35A.63 and RCW 36.70A. section 2. Amendment of SEPA Policies. The Federal Way city Code Chapter 18, Environmental Policy, section 18-122, (Ordinance Nos. 90-40, 91-109, 91-114, 92-130, 92-l36, 92-137, 92- 140, 93-184, and 93-202), is hereby amended as follows: ORD # 95-2<1> , PAGE 2 18-122 (a) (b) ORD # $-~ state Environmental policv Act - Policies The policies and goals set forth in this chapter are supplementary the existing to in those authorization of the city. City recognizes that each has person a fundamental and inalienable right to a healthful environment and that each has responsibility to contribute to the preservation person a and enhancement of the environment. (7) Federal Way Water and Sewer District Water System Plan 1991. (8) The Federal Way Comprehensive Parks, Recreation, and Open Space Plan. (9) The King county Fire Protection District No. 39 Long Range Plan. (10) The Federal Way School District No. 210 Capital Facilities Plan. (ll) The Federal Way Interim City Improvement Plan. (12) The Federal Way Solid Waste Management Plan (Ordinance No. 90-73). (13) The Federal Way Recycle Plan (Resolution No. 91-86) . (14) The Federal Way Transportation Improvement Plan (Resolution No. 91-67). (15) The Federal Way Hazardous Waste Management Plan (Resolution No. 90-27). (16) The Federal Way Surface Water Management Plan (Ordinance No. 90-31). (17) The Federal Way Private utility Element. (18) The King Countywide Planning Policies, to the extent currently adopted by the Federal Way city Council, and as may be adopted hereafter. (20) The Federal Wav Comcrehensive Surface Water Manaqement Plan. section 3. Severabilitv. The provisions of this ordinance are declared separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section, or portion of this ordinance or the invalidity of the application thereof to any person or circumstance, shall not affect the validity of the remainder of the ordinance, or the validity of its application to other persons or circumstances. section 4. Ratification. Any act consistent with the authority and prior to the effective date of this ordinance is hereby ratified and affirmed. section 5. Effective Date. This ordinance shall take effect and be in force five (5) days from and after its passage, approval, and publication, as provided by law.
