Ord 96-280 ORDINANCE NO. 96-280 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON AMENDING THE PROVISIONS RELATING TO FEDERAL WAY PARKS AND RECREATION COMMISSION. (AMENDING ORDINANCE NO. 91-93 AND ORDINANCE NO. 93-186). WHEREAS, the Federal Way City Council recognizes that parks and recreation are vital to the community's quality of life, important in attracting visitors and tourists, valuable as a source of commerce and industry, and desired by businesses considering location in the City; and WHEREAS, by Ordinance No. 91-93 the Federal Way City Council has provided for the establishment of the Parks and Recreation commission (the "commission") as amended by ordinance No. 93-186; and WHEREAS, it is necessary to provide for annual appointments to fill vacancies on the commission and to provide for the removal of commission members who are not fulfilling their responsibilities; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS: section 1. Amendment. section 11-27 of Article II. Parks and Recreation commission of the Federal Way City Code ("FWCC") shall be amended as follows: ORD # 96-280 , PAGE 1 C(Q)~1f ARTICLE II. PARKS AND RECREATION COMMISSION. Sec. 11-27. Membership. (a) The parks and recreation commission shall consist of nine (9) members appointed by the city council. (b) The parks and recreation commission shall serve without compensation. (c) Each member shall serve a term of three years'T ~ that sf the eri~inal ap~eintees te such cemmisaien. The citv council shall annually appoint new members to fill the expirinq terms on the parks and recreation commission. If. for anv reason. a vacancv occurs durinq the term of a parks and recreation commission member. the city council shall appoint a new member to fill the unexpired term of that member. The city council may remove a parks and recreation commission member at any time if the city council determines that member is not fulfillinq his or her responsibilities to the satisfaction of citv council. All members of the parks and recreation commission shall serve until their successors are dulY appointed bv city council. (d) Persons appointed to serve on the commission shall reside within the corporate limits of the city during the members' terms. (e) To the extent practicable, appointments shall reflect the ORD # 96-280 , PAGE 2 diversity of all recreational needs of the city. (Ord. No. 91-93, § l(D), 4-16-91) section 2. Severabilitv. The provisions of this ordinance are declared separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section, or portion of this ordinance or the invalidity of the application thereof to any person or circumstance, shall not affect the validity of the remainder of the ordinance, or the validity of its application to other persons or circumstances. section 3. Ratification. Any act consistent with the authority and prior to the effective date of this ordinance is hereby ratified and affirmed. section 4. Effective Date. This ordinance shall take effect and be in force thirty (30) days from the time of its final passage, as provided by law.
