OF FEDERAL WAY, WASHI:NGTON AMENDI:NG ORDI:NANCE
NO. 91-84, AMENDING THE PROVISIONS RELATING TO
FEDERAL WAY ARTS COMMI:SSI:ON.
WHEREAS, the artists and artistic institutions of Federal
Way contribute to and provide cultural, educational, entertainment
and recreational benefits available to and used by the citizens of
Federal Way; thereby enhancing the public environment and general
welfare; and
WHEREAS, the Federal Way city Council recognizes that the
arts are vital to the community's quality of life, important in
attracting visitors and tourists, valuable as a source of commerce
and industry, and desired by businesses considering location in the
City; and
WHEREAS, by Ordinance No.
91-84 the Federal Way City
Council has provided for the establishment of the Arts commission
(the "commission"); and
WHEREAS,
it
is
necessary
to
provide
for
annual
appointments to fill vacancies on the commission and to provide for
the removal of commission members who are not fulfilling their
responsibilities;
NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON,
DOES HEREBY ORDAIN AS FOLLOWS:

Section 1.
Amendment.
Section 2-58 of Division 2. Arts
Commission of the Federal Way City Code ("FWCC") shall be amended
as follows:
DIVISION 2. ARTS COMMISSION*
Sec. 2-58. Membership.
(a) The arts commission shall consist of eleven (11) members
appointed by the city council.
(b) The arts commission shall serve without compensation.
(c) Each member of the arts commission shall serve a term of

The citv council shall annuallv
appoint
new
members
to
fill
the
expirinq
terms
on
the
arts
commission.
If. for any reason. a vacancy occurs durinq the term
of an arts commission member. the city council shall appoint a new
member to fill the unexpired term of that member.
The city council
may remove an arts commission member at any time if the city
council
determines
that
member
is
not
fulfillinq
his
or
her
responsibilities to the satisfaction of city council.
All members
of the arts commission shall serve until their successors are duly
appointed by city council.

(d) Persons appointed to serve on the arts commission shall
reside within the corporate limits of the city during the members'
term.
(e)
To the extent practicable,
appointments
to the
arts
commission
shall
reflect
a balance
of
interests
in
fine
and
performing arts and preservation of cultural heritage.

Section
2.
Severability.
The
provisions
of
this
ordinance are declared separate and severable.
The invalidity of
any clause, sentence, paragraph, subdivision, section, or portion
of this ordinance or the invalidity of the application thereof to
any person or circumstance, shall not affect the validity of the
remainder of the ordinance, or the validity of its application to
other persons or circumstances.
section 3.
Ratification.
Any act consistent with the
authority and prior to the effective date of this ordinance is
hereby ratified and affirmed.
Section 4.
Effective Date.
This ordinance shall take
effect and be in force thirty (30) days from the time of its final
passage, as provided by law.
