Ord 98-312 ORDIRARCB NO. 98-312 AN ORDlRARCB 01' THB CITY COUNCIL 01' THB CITY OF FBDERAL ny, nsHINGTON, AHBRDING THB PROVISIONS RELATING TO PAlUtS AND RBCREATION COMMISSION MEMBERSHIP. (AMBI!IDDIG ORDIImNCB NUMBERS 91-93, 93- 186 and 96-280). WHEREAS, the Federal Way City Council recognizes that parks and recreation are vital to the community's quality of life, important in attracting visitors and tourists, valuable as a source of commerce and industry, and desired by businesses considering location in the City; and WHEREAS, by Ordinance No. 91-93 the Federal Way City Council created a parks and recreation commission (the "commission") as amended by Ordinance Numbers 93-186 and 96-280 and; WHEREAS, the Federal Way city Council set membership in the commission at nine members and the City Council has utilized nine voting members and two alternate non-voting members and; WHEREAS, a need exists to allow membership in the commission to consist of at least nine members and up to eleven members in order to provide the Federal Way City Council with flexibility in meeting work plan goals and; WHEREAS, the commission desires to increase participation in commission membership by limiting the terms of service to three consecutive-three-year terms; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS: section I. Amendment. The Federal Way city Code ("FWCC") ORD # 98-312 , PAGE 1 (C Ö ff2>V shall be amended as follows: FWCC Section 11-27 shall be amended as follows: Sec. 11-27. Membership. The citv council shall determine UDon the e~piration of anv member's term if a need exists to apDoint more than nine members to the commission. (b) The parks and recreation commission shall serve without compensation. (c) Each member shall serve a term of three years. Members shall serve no more than three consecutive terms upon council aDpointment. whether servina all or any portion of anv term. and this provision shall be applied retroactively. The city council shall annually appoint new members to fill the expiring terms on the parks and recreation commission. If, for any reason, a vacancy occurs during the term of a parks and recreation commission member, the city council shall appoint a new member to fill the unexpired term of that member. The city council may remove a parks and recreation commission member at any time if the city council determines that member is not fulfilling his or her responsibilities to the satisfaction of the city council. All members of the parks and recreation commission shall serve until their successors are duly appointed by the city council. Cd) Persons appointed to serve on the commission shall reside ORD # 98-312 , PAGE 2 .. u -----.--.-- within the corporate limits of the city during the members' terms. (e) To the extent practicable, appointments shall reflect the diversity of all recreational needs of the city. Section 2. Severability. The provisions of this ordinance are declared separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section, or portion of this ordinance or the invalidity of the application thereof to any person or circumstance, shall not affect the validity of the remainder of the ordinance, or the validity of its application to other persons or circumstances. section 3. Ratification. Any act consistent with the authority and prior to the effective date of this ordinance is hereby ratified and affirmed. section <I. Effective Date.
