ORDINANCE NO. 01 - 385
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF FEDERAL
WAY, WASHINGTON, AMENDING CHAPTER 22 (ZONING) OF THE
FEDERAL WAY MUNICIPAL CODE TO ADDRESS MAXIMUM HEIGHTS
AND OTHER MISCELLANEOUS CHANGES
WHEREAS, the City of Federal Way adopted Ordinance No. 96-270 in July, 1996, which
significantly revised the Federal Way City Code (FWCC), Chapter 22 (Zoning).
WHEREAS, the City of Federal Way finds that the amendments to FWCC, Chapter 22 (Zoning),
to modify standards relating to maximum heights and other miscellaneous changes will provide for
improved review processes.
WHEREAS, the City of Federal Way finds that the code amendments relating to maximum
heights and other miscellaneous changes will implement and is consistent with the Federal Way
Comprehensive Plan; and
WHEREAS, the City's SEPA Responsible Official issued a Detennination of Nonsignificance on
the code amendments relating to maximum heights and other miscellaneous changes on February 3,200 I;
and
WHEREAS, the Planning Commission conducted duly a noticed public hearing onJbe code
amendments relating to maximum heights and other miscellaneous changes on February 21,2001, and
forwarded a recommendation of approval to the City Council; and
WHEREAS, the Land Use Transportation Committee ofthe Federal Way City Council
considered the code amendments relating to maximum heights and other miscellaneous changes on March
5,2001, following which it recommended adoption of the text amendments.

WHEREAS, the City Council finds that the code amendments relating to maximum heights and
other miscellaneous changes are consistent with the intent and purpose of FWCC, Chapter 22 (Zoning) to
provide for and promote the health, safety, and welfare of the general public.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. Findings. After full and careful consideration, the City Council of the City of Federal
Way finds that the proposed code amendments will protect and will not adversely affect the public health,
safety, or welfare.
Section 2. Conclusions. Pursuant to FWCC Sections 22-216 and 22-528, and based upon the
Findings set forth in Section I, the Federal Way City Council makes the following Conclusions of Law
with respect to the decisional criteria necessary for the adoption of the proposal:

The proposed FWCC text amendments are consistent with, and substantially
implement, the following Comprehensive Plan goals and policies:
LUGI Improve the appearance andfunction of the built environment.
LUP () Conduct regular reviews of development regulations to determine how to
improve upon the development review process.
LUG3
Preserve and protect Federal Wiry'S single family neighborhoods.
LUPI5
Protect residential areas from impacts of adjacent non-residential uses.
2.
The proposed amendment bears a substantial relationship to public health, safety, or welfare
because they will result in improved review processes, by providing consistency between
requirements and standards; -.
and
3.
The proposed amendment is in the best interest of the residents of the city because they will
improve review processes by clarifying and standardizing requirements, resulting in increased
efficiency and effectiveness of City resources.
Section 3. Amendment. FWCC, Chapter22 is amended as set forth in the attached Exhibit A.
Section 4. Severability. The provisions of this ordinance are declared separate and severable.
The invalidity of any clause, sentence, paragraph, subdivision, section, or portion of this ordinance, or the

invalidity of the application thereof to any person or circumstance, shall not affect the validity of the
remainder of the ordinance, or the validity of its application to any other persons or circumstances.
Section 5. Ratification. Any act consistent with the authority and prior to the effective date of
this ordinance is hereby ratified and affinned.
Section 6. Effective Date. This ordinance shall be effective five (5) days after passage and
publication as provided by law.

1. The minimum amount oflot area per dwelling unit is as follows:
a. In RM 3.6 zones, the subject property must contain at least 3,600 sq. ft. oflot area per dwelling unit.
b. In RM 2.4 zones, the subject property must contain at least 2,400 sq. ft. oflot area per dwelling
unit.
c. In RM 1.8 zones, the subject property must contain at least 1,800 sq. ft. of lot area per dwelling unit.
2. The subject property must contain at least 400 sq. ft. per dwelling unit of common recreational open
space usable for many activities. At least 10% of this required open space must be developed and
maintained with children's play equipment. If the subject property contains 4 or more units, this
required open space must be in one or more pieces each
having a length and width of at least 25'. In addition, if the subject property contains 20 or more units,
at least 50% of this required open space must be in one or more pieces each having a length and width
of at least 40'.
3. No facade of any structure may exceed 120' in length. In addition, any facade of a structure that
exceeds 50' in length must be modulated as follows:
a. The minimum depth of the modulation is 3'.
b. The minimum width of the modulation is 4'.
c. The maximum width of the modulation is 35'.
4. Except for detached dwelling units, ¡if any portion of a structure on the subject property is witIHß less
than 100' Ðffrom an adjacent low density zone, then either:

1. This use may be permitted only if it meets the following criteria:
a. The proposed development will be compatible with surrounding uses.
b. The proposed site plan demonstrates sensitive and thoughtful layout of the manufactured home park
considering the size and configuration of the subject property, the topography and natural feature of the subject
property and the nature of the surrounding area.
c. The proposed site plan avoids repetitive siting of the manufactured homes and encourages privacy for the
residents of the manufactured homes.
d. The streets providing access to the subject property are adequate to support the movement of manufactured
homes to and from the subject property.
2. There be at least a 15' separation between manufactured homes on the subject property.
3. The subject property must contain at least 400 sq. ft. per dwelling unit of common recreational open space
usable for many activities. At least 10% of this required open space must be developed and maintained with
childrens' play equipment. If the subject property contains 4 or more units, this required open space must be in
one or more pieces each having a length and width of at least 25'. In addition, if the subject property contains 20
or more units, at least 50% of this required open space must be in one or more pieces each having a length and
width of at least 40'.
4. No facade of any structure may exceed 120' in length. In addition, any facade of a structure that exceeds 50' in
length must be modulated as follows:
a. The minimum depth of the modulation is 3'.
b. The minimum width of the modulation is 4'.
c. The maximum width of the modulation is 35'.
5. Each manufactured home must be placed on a permanent foundation or otherwise securely anchored and
stabilized. Unless on a foundation, the base of each manufactured home must be surrounded by a skirt. In
addition, the exterior appearances of the manufactured homes shall be compatible with the character of existing
dwelling units in the area.
6. If any portion of a structure on the subject property is witßiß less than 100' Gf from a low density zone, then
either:
a. The height of that Dortion of the structure shall not exceed 15' above average building elevation; or

4) The extent to which the proposal is consistent with the public health, safety, and welfare.
2. The facility and program must secure and maintain all licenses and/or approvals as required by the
state, including verification from the Department of Juvenile Justice, which shall be reviewed by the
Police Department, that the proposed facility meets state standards for such facilities and that the facility ,
will meet state laws and requirements. '
3. The program must be operated under the authority of a reputable governing board, social service, or
government agency, or proprietor, to whom staff are responsible and who will be available to city
officials, if necessary, to resolve concerns pertaining to the facility.
4. The facility will have staffing, supervision, and security arrangements appropriate to the number of
clients and to its hours of operation.
5. The subject property must be situated in close proximity to, and have convenient access to, public
transportation, shopping, health care providers, and other services and facilities frequently utilized by the
residents of the property.

1. The city may pennit this use if it meets the following criteria:
a. The housing will be available for the exclusive occupancy of persons over 55 years of age.
b. The subject property is situated in close proximity to, and has convenient access to, public
transportation, shopping, health care providers and other services and facilities frequently utilized by the
intended residents of the subject property.
c. The proposed development will not create unreasonable impacts on traffic, public utilities and services
or on nearby residential uses as compared to these impacts which would likely result from development of
the subject property with stacked or attached dwelling units to the maximum density pennitted in this
zone.
2. The city will detennine the number of dwelling units or occupancy rooms or suites in the proposed
development and may pennit or require modification of the required yard, lot coverage, height,
landscaping and other similar dimensional and site design requirements based on the following criteria:
a. The specific nature of the occupancy and the persons that will be housed in the proposed development.
b. The size of the dwelling units or occupancy rooms or suites and the specific configuration of and
facilities within these units, rooms or suites.
c. The impacts on nearby residential uses of the proposed development.
d. The architecture, site design and other design features of the proposed development.
3. The city may approve the limited commercial establishments listed in paragraph a. below, if all of the
following criteria are satisfied:
a. The retail establishments will be clearly accessory to the primary residential use of the subject property
and the retail establishments are intended primarily or exclusively for the residents of the subject property
and their guests.
b. Locating limited commercial uses on the subject property is clearly reasonable considering the site of
the subject property, the location of the subject property and access to the subject property.
c. Any adverse impacts or undesirable effects oflocating retail establishments on the subject property can
be eliminated or significantly reduced through conditions imposed as part of the approval.
d. The retail establishments will be under common management with the residential uses on the subject I
property.

FWCC CHAPTER 22, ZONING
Sec. 22.1. Definitions
Adjoining shall mean property that touches or is directly across the street from the subject
property. For the purpose of height regulations, any portion of a structure which is more
than 100 feet or more from a low density zone is not considered to be adjoining that zone.
Business College or Vocational School shall mean a post-secondary institution that offers
instruction in business principles and practices that will enhance one's ability to perform
in a business setting, i.e., secretarial, accounting, purchasing, computers programming or
usage, or training in fields such as health services, restaurant management, real estate,
beautician training, or ~ professional training or continuing education in these or
similar professions.
College or university shall mean a post-secondary institution for higher learning that
grants associate or bachelor degrees and may also have research facilities and/or
professional schools that grant master and doctoral degrees. This may also include
community colleges that grant associate or bachelor degrees or certificates of completion
in business or technical fields.
Gvmnasium is a room or building equipped for sports tþat must þe accessory to a sc~
facility. health club. social service c~he Boys & GirlÚ4YÞ or simi~ar facility.

Schools shall mean institutions of learning, excluding those offering post secondary
education, offering instruction in the several branches of learning and study required by
the Basic Education Code of the State of Washington to be taught in public, private and
parochial schools, including those disciplines considered vocational, business-related, or
trade in nature.
Trade (er wJcE1tienal) school shall mean a post-secondary institution that trains persons
for qualification in specific trades or occupations, i.e., mechanics; construction trades
such as carpentry, BV AC, and wiring; electronics repair and service including
computers; plumbing; chefs and culinary training; upholstery; and bartending; @t8.
