Res 90-034 - 0072.16003 JDW/naa 04/17/90 RESOLUTION NO. 90-34 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, REQUESTING KING COUNTY TO TURN CERTAIN FUNDS OVER TO THE CITY WHICH HAVE BEEN DEPOSITED WITH THE COUNTY FOR PURPOSES OF INSTALLATION OF A TRAFFIC SIGNAL AT 10TH AVENUE S.W. AND S. W. CAMPUS DRIVE, WITHIN THE CITY LIMITS OF THE CITY OF FEDERAL WAY. WHEREAS, King County has collected $15,200 from two developers as partial payment for the installation of a traffic signal at 10th Avenue S. W. and S. W. Campus Drive to mitigate the impacts from the proposed developments, and WHEREAS, since the payment of said funds to King County by the developers, the City of Federal Way has incorporated and the intersection at which the proposed traffic signal is to be installed is now within the corporate limits of the new City of Federal Way, and WHEREAS, Amercon Development Corporation has volunteered to pay for the remainder of the cost of acquisition and installation of the proposed traffic signal at said intersection, in conjunction with a separate development over and above the sums collected by King County, and WHEREAS, it is in the interests of the public health, safety and general welfare that said traffic signalization be accomplished, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: JDWO0816R -1- COpy section 1. The city council of the City of Federal Way, Washington, hereby requests that King County pay over to the City the $15,200 which King County has collected to pay for a portion of the costs of the traffic signalization at the intersection of 10th Avenue S. W. and S. W. Campus Drive. The sums that King County has collected consist of $4,300 from the Polygon Corporation and $10,900 from L & H Development for payment of their shares of the required traffic signalization; that said sums, together with any interest which has accrued thereon, should be turned over and delivered to the City of Federal Way for the purpose of obtaining installation of said traffic signalization. section 2. The City of Federal Way, upon the receipt of said funds, hereby commits to spend said funds for the installation of the traffic signal at the intersection of 10th Avenue S. W. and S. W. Campus Drive, known as King County Project No. 10003.3. The city will see that said funds and any interest accrued thereon shall be expended for the project and the purpose for which said funds were deposited with the county.
