A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF FEDERAL WAY, WASHINGTON, AUTHORIZING AND
DIRECTING EXECUTION OF A COOPERATIVE
PURCHASING AGREEMENT WITH THE CITY OF SEATTLE
FOR COMMUNICATIONS EQUIPMENT AND RELATED
SERVICES.
WHEREAS,
radio communication by public agencies is a
matter requiring coordination among those agencies; and
WHEREAS,
the Interlocal Cooperation Act provides for
intergovernmental cooperation between local agencies of government
including joint purchasing¡ and
WHEREAS, a request for proposals has been developed that
will
fill the needs of several jurisdictions
in King County,
conforming to the procurement requirements of each¡ NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON,
HEREBY RESOLVES AS FOLLOWS:
Section 1.
The
City
Manager
or
his
designee
is
authorized to execute a Cooperative Purchasing Agreement between
the City of Federal Way,
Seattle, Bellevue and Port of Seattle
regarding potential purchase of goods and services related to an
800 MHZ trunked radio system.

COOPERATIVE PURCHASE AGREEMENT
BETWEEN THE CITY OF FEDERAL WAY AND THE CITY OF SEATTLE
Terms of Aqreement
1. The City of Federal Way and the city of Seattle agree to
the joint solicitation and potential purchase of radio equipment
and related services under one or more contracts established by
procurement procedures as to enable the other party to purchase or
acquire goods or services based upon said contracts.
2. The City of Seattle shall include in its request for
proposal for equipment the items listed in Exhibit "A," attached,
which either city may purchase if offered by a vendor.
3. The method of financing or payment shall be through
budgeted funds or other available funds of the purchasing agency.
Any services or goods procured by the purchasing agency under these
contracts shall remain the exclusive property of or under control
of said purchaser.
4. This agreement is expressly made under the provisions of
Chapter 39.34 RCW. Both parties understand and agree that
contracts with vendors pursuant to this agreement may include
purchases (a) by one city acting as agent for either both parties
in securing the best price and terms on one or more items or kinds
of property for a time period specified in such contract, under RCW
39.34.030 or 39.34.080, or (b) by one city as agent for the other
in procuring specific items of property, pursuant to a specific
request made in writing by the purchaser, under RCW 39.34.080, or
(c) joint purchase agreements relating to one or more specific
items of property, pursuant to RCW 39.34.080
It is further understood that in all such cases the party
making such purchase will comply with all purchasing requirements
applicable to either party.
5. This agreement shall remain in force until canceled by
either party in writing.
6. The administrative contract in the city of Federal Way
will be the Public Works Director. The administrative contact with
the City of Seattle will be the city of Seattle Purchasing Agent
who is the Administrator of this contract.
7. Any personal property acquired through the use of this
contract will be held and used by the purchasing agency until the
time such property is of no further value or use to the purchaser,
and at that time it will be disposed of as required by the laws
than in effect governing such disposal.

Exhibit A
The Interagency Agreement between the City of Federal Way and the
City of Seattle would allow the city of Federal Way to enter into
contract(s) with vendors on the basis of proposals they submit in
response to Seattle's RFP for an 800MHz trunked radio system. That
RFP calls for proposals for the following services and products
which the city of Federal Way may eventually buy under such
contracts.

A Microwave Backbone System including
Microwave towers, facili ties for housing control
equipment, microwave transmission equipment,
microwave control equipment, software for microwave
control and management, technical support for
installing and possibly operating or maintaining
such a system.
Radio equipment including
Antennae, repeaters, radios, radio consoles, software
and miscellaneous hardware for support of a radio
system, technical support for installing and
possibly operating or maintaining such a radio
system.

System Design and Installation Services
Application for necessary frequencies, detailed design
drawings and documentation, installation, training,
operations and maintenance services in support of
the above system and the interface to other systems
in the region.
4.
other Miscellaneous Equipment and services which might be
necessary to design, install, and support a regional
radio system in conjunction with other regional
systems.
