Res 91-068 RESOLUTION NO. 91-68 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, APPROVING THE FINAL PLAT OF STEEL LAKE CIRCLE, DESIGNATED AS KING COUNTY BUILDING AND LAND DEVELOPMENT FILE NO. 687-23. WHEREAS, the preliminary plat for Steel Lake Circle, designated Building and Land Development File No. 687-23, was approved subject to conditions on June 1, 1987, by King County Ordinance No. 8254; and WHEREAS, applicant applied for an extension of the above- referenced preliminary plat; and WHEREAS, the Federal Way City Council approved such extension, upon conditions; and WHEREAS, the applicant has at this time applied for final plat for the above-referenced plat; and WHEREAS, City of Federal Way Community Development staff, having reviewed the proposed final plat for its conformance to the conditions (modified) of the preliminary plat and to the conditions for extension of deadline for final plat approval¡ NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY DOES HEREBY RESOLVE AS FOLLOWS: section 1. Findinas of Fact. The Federal Way City Council makes the following Findings of Fact: 1. The final plat for Steel Lake Circle, Building and Land Development File No. 687-23, is in substantial conformance to the preliminary plat and is in conformance with applicable zoning ordinances or COpy other land use controls in effect at the time of submittal of the substantially complete application. 2. All conditions recommended by the Zoning and Subdivision Hearing Examiner for King \ County, Washington, contained in report and recommendation to King County Council dated September 11, 1987, and conditions for extension to deadline for final plat approval have been satisfied, and/or satisfaction of the conditions have been sufficiently guaranteed by the applicant. 3, Eighty-five percent of all required improvements have been made and sufficient bond has been accepted by King County and the City of Federal Way as financial guaranty for completion of all required plat improvements. 4. All taxes and assessments owing on the property being subdivided have been paid. Section 2. ADDroval. Based upon the above Findings of Fact and pursuant to Federal Way Zoning Code 16.410, the final plat of Steel Lake Circle, Building and Land Development File No. 687- 23, is approved, subject to satisfaction of: 1. Those conditions as contained in the Report of Subdivision Hearing Examiner dated September 11, 1987, attached hereto as Exhibit A and incorporated by reference, and 2. Those conditions imposed as a condition of granting -2- an extension to the date for preliminary plat approval as set out in Exhibit B, attached hereto and incorporated by reference. 3. Bonds sufficient to guarantee satisfaction of the conditions that are required by the City. Section 3. Recording. The approved and signed final plat, together with all legal instruments pertaining thereto as required pursuant to Federal Way Zoning Code, shall be recorded by the applicant in the King County Department of Elections and Records, All recording fees shall be paid by the applicant. On April 6, 1987, the King County 8uilding and Land Developmeot Division received an applic"ion for preliminary approval of the proposed plat of Steel Lake Circle. The property i, a three acre site on which 10 residential building 10" were propo"d. The application was accompanied by an environmental checklist, "' required by the St"e Environmental Policy Act and regul"ions. 3. On May 19, 1987, the King County Building and Land Development Division, as lead agency pursuant to the St"e Environmental Policy Act, issued a determination of environmental non-significance I DNSI for the proposed development. That determination w"' ba'ed upon the opinion of the responsible official th" the proposed development would not have a probable ,ignificant adver'e impact upon the environment. On June 1, 1987 a timely appeal of the DNS was submitted by Richð[d B. Feutz on behalf of the Steel Lake Residents Association. 4. Potential destruction of a fish habitat area. 5. The subject property is at the Western edge of the Steel Lake drainage sub-basin. The environmental checklist indicated that the outfall from the stormwater retention/detention system on the subject property would result in flow to the weSt, along the north side of s. 30Hh Street, for approximately 300 feet to a natural Storm drainage leading to Redondo. However. the drainage review undertaken by King County, as we] I as preliminary d"inage plans prepared on behalf of the applicant, indicate that the natural drainage from the subject property is to the southeast, into Steel Lake. The direction of flow anticipated in the preliminary technical committee review is through a pipe, located on an easement across property at 211] S. 30Hh Street (Anòerson property), from S. 30"h Street into Steel Lake. 6. Steel Lake drains a sub-basin of approximately 240 acres, which is a relatively small basin area for a lake of its size. Approximate]y]O acres of this area remain undeveloped. including the three acre subject properry. If the entire undeveloped 10 acres were permitted to develop and discharge directly into the lake, with no provision for stormwater detention, it would affect the depth of the lake by approximately one inch. 7. The outflow from Steel Lake is to the northwest, passing under S. 30"h Street and continuing northwest, flowing under Pacific Highway S. to Redondo, where it reaches puget Sound. The outflow is partially blocked at the lake, and only operates when the lake reaches its higher Stages in the winter. A three foot seasonal variation in lake depth is currently experienced. This is primar\1y the result of development which has previously occurred in the basin without provision for stormwater retention/detention, and the partial blockage of the lake outflow. 8. The existing 36 inch d"in pipe across the Anderson property, which leads from S. 30Hh Street to the lake, has no O\1/water separator or other pol Jut ion control. As a result, substantial pollution of the lake is evident at the outfall from this pipe. In addition, the pipe annually carries one to two cubic yards of sediment into the lake. Without regord to the action which King County takes on the application for preliminary approval of the proposed plat of Steel Lake Circle, the King County Department of Public Works intends to instal] an oil/water separator immediately up stream of the Anderson culvert during the current conStruction season. EXHIBIT PA.GE" 9. The drainage review section of the BUilding and Land Development Division h" recommended condition, for the approval of the proposed plat of Steel Lake Circle, which conditions would address the concerns of the appellant with respeCt to sedimentat ion and pollution of the lake. The recommended condition, would "quire ero'ion and sediment control facilities during construction, to insure that sediment-laden water does not leave the subject site or enter the natural drainage system,. They would aho requi" that oil/watee 'epacation facilities be provided at each point of release of stormwater from the site, and that 200 feet of natural biofiltration or equivalent be provided prior to dischörge of Hormwater into any stream, wetland or lake. In addition, a downst"am analy'i, from the subjeCt property to Steel Lake would be required, to address any existin9 problems with flooding, capacity, erosion or sedimentation of any drainage facility, vhethee natural or man-made. 10. It would be possible to redirect the ,tormwater drõinage from the subject propeety to the vest, along S. JOHh Street, through an existing ditch located approximately 50 feet west of the proposed intersection of 20th Avenue S. To do so would involve the installation of approxiately 515 lineal feet of storm drainage pipe at depths ranging from 3 to 15 feet. Although directing drainage to the west would circumvent the naturõl flow into Steel Lake, the drainage would ultimately flow into the same drainage b"in, and no intervening properties. other than King County right-of-way, would be affected. 11. Drainage to the west, consistent with the preceding finding, would have the advantage of enabling the applicant to locate the drainage retention pond further to the south on the subjeCt property, assuring that all 'tormwater from the plat is routed throu9h the pond. ,his new pond location would also free additional land for development, sufficient to enable the applicant to create one additional lot, subject to meeting other requi"ments of the RS 7200 zone classification. This would provide' the applicant and King County with the benefit of an additional building lot on the subject property, consistent with the Comprehensive and Community Plan. 12. The applicant has acquired additional property rights to the west of the ori9inally proposed entrance road. This enables the inteesection of 20th Avenue S. and S. JOHh Street to be constructed at the crest of the hill, where there is improved sight distance to the east and west. s. 30Hh Street, although heavily used, functions at a level-of-service which exceeds the requirements of the King County road adequacy ordinance (Ordinance 75441. The design and construction of the intersection of 20th Avenue S. with S. 304th Street can provide for safe school bus loading and unloading zones, for buses traveling both e"t and west, as determined to be necessöry by the Kin9 County department of public works in consultation with the Pedeeal Way School District. Standörd intersection approach warning si9ns, together with school bus loading zone wörnin9s, can be provided if warranted. 13. In order to mitigate possible impacts of the proposed development on properties adjacent to the east, which properties presently receive s",face and sub-surface water runoff from the subject property, the applicant has proposed the construction of interceptor trenches (french d r a i ns I . In order to lessen the visual impact< and possibility of erosion affecting property to the east, the applicant has also offered to provide a 15 foot setback and landscaping around the proposed detention pond. Although that offer was made when the detention pond tract was proposed adjacent to Lots 16 and 11 of Steel Lake Estates, the rationale for the proposed setback and landscaping continues to exist if the detention pond is relocated further to the south. The applicant has also offered to provide a fence around the detention pond if requested by the adjacent property owners. 15. The possibility of erosion from the subject property adversely affecting Steel Lake to the south, as a result of the natural flow of stormwater from the subject property to Steel Lake, makes it reasonable to require that construction activity on the site, prior to the installation of stormwater retention/detention facilities. be limited to the dryer months of the year. The applicant has agreed to such a limitation. f~~: 1. Although Steel Lake presently experiences a seasonal variation in depth of up to three feet, the proposed development of Steel Lake Circle, if implemented with the conditions recommended by the King county drainage rev,ew section of the Building and Land Development Division, would have an insignificant effect upon the volume of "'.:er enteriog Steel Lake. The preponderance of the evidence is that the reasonable method to address problems of excessive volume and depth of the lake is through maintenance and enhancemeot of the lake outflow. 2. If approved subject to the conditions recommended by the drainage review section, the pcoposed development of 10 lots for cesidential use upon the subject pcoperty would not have more than a modecate impaCt upon the water quality of Steel Lake. 3. In making a threshold determination of enviconmental significance or non-significance, the responsible official is required to considec miti9ation measuces which an agency or the applicant will implement as part of the proposal. WAC 191-11-))O(1)(cl. Accordingly, the 8uilding and Land Development Division, in makin9 the threshold determination of environmental non-significance, properly considered the conditions recommended by the engineering review section, based upon the likelihood that those conditions would be imposed if preliminary approval of the proposed plat is granted. 4. In considerin9 an 'ppeal of a determination of environmental significance or non-significance, the decision of the lead agency is required to be accorded subatantial weight. RCW4J.21c.O9D. 5. The May 19, 1981 threshold determination of environmental non-significance of the Building and Land Development Division was neither arbitrary and capricious nor clearly erroneous. Accordingly, the appeal of the threshold determination of environmental non-si9nificance should be denied. EXHIBIT -A- PAGE-"-.:.0~ IS P age 6 6. If approved subject to the conditions recommended below, the proposed subdivision "ill comply "ith the goals and objectives of the King County Comprehensive Plan, federal way Communlty Plan, Subdlvision and Zoning Codes, and other official land OSe controls and policies of King County. 7. If approved subject to the conditions recommended below, this proposed SUbdi'ision will make appropriate provision for the public health, safety and general welfare and for drainage ways, streets, other public ways, water supply, and sanitary wastes; and it will serve the public use and i n t ere st. 8. The conditions for final plat approval recommended below are in the public interest and are reasonable requirements. 9. The dedications of land or easements within and adjacent to the proposed plat, as recommended by the conditions for fioal plat approval or as shown on the proposed preliminary plat submitted by the applicant, are reasonably necessary as a direct result of the development of this proposed plat. 10. The public health and welfare will best be served by reducing the entry of pollutants and sediment into Steel Lake through the existing drainage on the Anderson property, and by improving the outfall from Steel Lake in order to improve the Sëabilization of the lake water level. However, the existing problems of pollution and seasonal variation of water level are not the result of past or proposed development on the subjeCt property. Su'ch improvements would be a general benefit to the Hea. which the applicant should not be required '0 provide (except as is necessary to accomodate this proposed development wlthout addittonal adverse impact to the the envlronmentl. Under all the existing facts and circumStances of this proposal, the most reasonable method of handling stormwater runoff from this proposed development, followlng detention and filtratlon on the subject property, is to provlde for the flow of that water to the west, along S. 30Hh Street, to the existing drainage way which passes under S. 30Hh Street and will convey the water to puget Sound at Redondo. Thls is the natural, ultlmate flow of Stormwater from the Steel Lake basin. Although a minor alterarion of flow within the basin would be accomplished, any agqravation of the existing POllution and water volume problems of Steel Lakewould be avoided. 11. In order to amellorate existlng problems of drainage on to the adjacent lots eaSt and south of the subjeCt property. and avoid any aggravation of those problems by this development, interceptor ditches (french drains I to colleCt and divert ground '.,ter which flows along the top of the hard pan substratum, should be required in connection with this development. 12. In light of the offer by the applicant to provide setbacks, landscaping and fencing to reduce the visual impact and enhance the safety of the applicant's proposed drainage facility, the approval of the final plat should require a IS foot setback and landscaping surrounding the detentlon pond, where it abuts adjacent residential property, together "ith a securley fence. The intersection should be designed and constructed, at both the north and south sides of S. 30Hh Street, to accommodate school bus loading and unloading ,ones, if determined to be needed by the Building and Land Development Division, following consultation with the federal way School District. All persons having an ownership interest in the subject property shall sign on the face of the final plat a dedication which includes the language as set forth in King ,County Council ",otion No. 5952. The dimensions of all lots shall meet the minimum requirements of the RS 7200 zone classification, or shall be as shown on the f~the approved preliminHY plat, "' modified by Exhibit B to the Augu" 25, 1987 letter of George J. Lindsey to the Zonin9 and Subdivision Examiner. (A copy of said Exhibit B is attached to this report and recommendationl. Minor lot-line revisions may be considered. The revised configuration and number of lots shall be subject to final approval by the Subdivision Technical Committee, to assure compliance with all requirements of the zone classification, All construction and upgrading of public and private roads shall be done in accordance to the standards e"ablished and adopted by Ordinance No, 4463 and 5725, as amended. 5. If an area-wide fire protection assessment is authorized by King County prior to final recording of this plat, this plat shall be subject to any assessment provided by that ordinance. The applicant must obtain the approval of the King County fire Marshal for the adequacy of the fire hydrant, water main, and fire flow standards of Chapter 17.08 of the King County Code. 7. Although the drainage provisions listed in this report represent only a portion of the requirements established in King County Code 9,04, all provisions of the code mu" be met. Dischacge of stormwot" shall be directed to the west, into an existing dCòinage facility on the north side of S. 30nh Street, approdmotely 50 feet west of 20th Avenue S. DCòinage plans shall be "bmitted for review to BALD Subdivision Product Section to ensure compliance with King County Code. Approval of these plans is necessacy PClor to any construction. 9. The storm d"inage plans must include retention/detention facilities required by Xing County Code 9.04. These facilities shall be placed in separate tracts with drainage easements for maintenance. Access to the facility shall be provided with a fifteen (151 foot County standacd crushed rock access roadway delineated within an easement for ingress/egress between the fad lity and public roadway, unless otherwise approved by King County. 10. Prior to recording of the final plat, those portions of the retention/detention facility necessary to accommodate the control of flows dischacging from the site shall be constructed and operational. The balance of the storm water system and the roadway must be constructed prior to recOrding of the final plat unless the remainder of the construction costs are covered by an appropriate construction bond at the time of recordin9. Prior to recording, site cleacing shall be limited to those areas required for construction of roadways and utility installation. Additional cleacing for model home lots may be allowed provided no sensitive aceas are prese;:;ton or adjacent to the lots. 13. êrosion and sediment control (ESC) facilities must be provided to ensure sediment-laden woter does not leave the, subject site or enter the natural dCòinage systems. These facilities must be installed prior to cleacin9 and building construction and must be maintained until constuction and landscaping are complete or until the potential for on-site erosion has passed. ESC plans for this project shall identify aceas to be cleaced and graded (limits of cleacingl and shall provide a schedule of construction (construction sequencel. The original contractor, Ryker Construction ~f Federal Way, could not, for various reasons, complete the construction of this plat and in July of 1990 we agreed to purchase the mostly-completed plat from him and complete the work and submit it to the county for final approval. The paperwork that we received for this plat was in extreme disarray; many documents were missing. We managed to straighte~ out the problems and complete the construction by late octob,er of 1990, We did not have the proper paperwork to indicate that we needed to apply for an extension. To that date, the sidewalk, curbs and streets were complete. All surveys and monuments were set. Water and sewer systems were complete, approved, and functioning. Power, telephone, gas and television utilities were installed and energized. The storm system was complete and functioning properly and the first final-plat inspection had been made, Only a small punch list remained. At this point we went to work with Doug Kay at King cty. BALD to process the final paper work. In late January of 1991 he discovered that the application for recording needed to be submitted to the city of Federal Way. We, with his help, had prepared everything for the King County Council. At this point we had to redo all of the required forms, plat certificates and layouts in a new format. In late March we were ready to submit to Federal Way when Doug Kay discovered that the plat had expired in late October of 1990. Nobody at King County had discovered this oversight until then. The neighborhood is designated walking to Wildwood Elementary and to Federal Way High School, so a stop will only be needed for Kilo Junior High. In its present configuration, a stop can be safely placed on South 304th, and when the development is complete to the west, we may travel around the block. Therefore no special provisions are necessary for bus access. However, I would suggest that walking access to the east of the cul-de-sac be developed as a path to Wildwood Elementary, so those students do not have to walk on South 304th.
