A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF FEDERAL WAY, WASHINGTON, OPPOSING THE
GRANTING OF VARIANCES BY THE PORT OF SEATTLE
TO THE SEATTLE-TACOMA INTERNATIONAL AIRPORT
NIGHTTIME LIMITATIONS PROGRAM.
WHEREAS,
the
nighttime
limitation
program
(NLP)
for
operators at Seattle-Tacoma International Airport was negotiated in
1990 between the Port of Seattle and airline operators, including
Federal Express, Alaska Airlines and Burlington Air Express; and
WHEREAS, the NLP limits nighttime aircraft noise between
12:00 a.m. and 6:00 a.m. beginning October 1, 1992, by prohibiting
use of stage 2 aircraft; and
WHEREAS, Federal Express, Alaska Airlines and Burlington
Air Express have made application to the Port of Seattle for
variances from requirements of the NLP to allow continued use of
stage 2 aircraft following the October l, 1992 deadline; and
WHEREAS, nighttime aircraft noise exposure adversely
impacts residents surrounding Sea-Tac Airport, including residents
of Federal Way; and
WHEREAS, Federal Express, Alaska Airlines and Burlington
Air Express participated,
negotiated and committed to the NLP
requirements; and,
WHEREAS, Federal Express, Alaska Airlines and Burlington
Air Express have been aware of the requirements contained in the
NLP
for
two
years
and
have
had
sufficient
opportunity
and
technological capability to accommodate requirements of the NLP;
and

WHEREAS, until all requirements of the Sea-Tac Airport
noise mediation agreement are in place, the NLP provides needed
interim relief to those residents impacted by nighttime aircraft
noise exposure; and
WHEREAS, there is no compelling evidence presented by
Federal Express, Alaska Airlines or Burlington Air Express which
justifies the requested variances based on required decisional
criteria contained in the NLP; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF FEDERAL WAY DOES HEREBY
RESOLVE AS FOLLOWS:
The City Council of the City of Federal Way opposes, and
the Port of Seattle is urged to deny the variances requested by
Federal Express, Alaska Airlines and Burlington Air Express to
allow use of stage 2 aircraft during nighttime hours beyond the
October 1,1992 deadline.
The Port of Seattle is strongly urged to
uphold the
requirements
of
the
nighttime
limitations
program
previously negotiated by the parties in order to prevent further
adverse noise impacts to surrounding residents including those
within the City of Federal Way.
