A RESOLIITION OF THE CITY COIINCIL OF THE CITY
OF FEDERAL WAY, WASHINGTON, AMENDING
RESOLOTION NO. 92-123 TO REDIICE THB PROCE88 I
APPLICATION FEL TO BE PAID BY AMATEIIR RADIO
OPERATORS IN CONNECTION WITH INSTALLATION OF
NONCOMMERCIAL RADIO ANTENNAS AND ESTABLISHING
AN EFFECTIVE DATE.
WHEREAS, the City of Federal Way has previously adopted alfee
schedule setting forth the various applications and permit ',fees
processed and issued by the City of Federal Way pursuanit to
Resolution No. 92-123; and
WHEREAS, Resolution 92-123 provides that a fee equal to �ight
Hundred Forty Dollars and NO/100 ($840.00) shall be paid by
applicants for all Process I reviews; and
WHEREAS, Section 22 of the Federal Way City Code ("F'i�CC")
requires a Process I review for the installation of noncommencial
amateur radio antennas if the height of the antenna exceedsi the
maximum height limit for structures established by the FWCC; and
WHEREAS, the Federal Way City Council has determined 'that
amateur radio operators' assistance with telecommunications during
emergencies or disasters constitutes a benefit to the Cit�i of
Federal Way and promotes the public health, safety and welfa�te of
its citizens; and
WHEREAS, the Federal Way City Council has determined that the
current Process I review required for applications to iristall such
noncommercial radio antennas in excess of the maximum height
limitations pursuant to Federal Way City Code Section 22-1047(�) is

appropriate and is not in violation of the Federal "limited
preemption" rule adopted by the Federal Communications Commission
("FCC") pursuant to that certain Memorandum Opinion and Order dated
Septeniber 19, 1985, issued by the FCC; and
WHEREAS, in order to reasonably accommodate amateur radio
operators, the City Council has determined the Process I fee shall
be reduced to One Hundred Dollars and NO/100 ($100.00) for
applications for the installation of noncommercial radio antennas;
NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, DOES
HEREBY ORDAIN AS FOLLOWS:
Section 1. Resolution 92-123 , Exhibit "A", Section Seven, is
hereby amended as follows:
SECTION SEVEN. LAND USE FEFS.
A. FEDERAL WAY LAND USE FEES SIiALL BE AUTOMATICALLY ADJUSTED
ANNUALLY EFFECTIVE JANUARY 1ST OF EACH YEAR FOR T� YEARS
1993, 1994, AND 1995, SET OUT IN TffiS SCHEDULE.
IN ADDITION, FOR EVERY YEAR OF THE SCHEDULE, A FIRE DISTRICT
ADNIINISTRATIVE FEE IN AN AMOUNT EQUAL TO FIVE PERCENT (5%) OF
THE LAND USE FEE Il1�IPOSED SHALL BE CHARGED AND COLLECTED BY
THE CITY AND PAID TO THE FIRE DISTRICT. THE FIRE FEE IS NOTED
IN BOLD BENEATH EACH FEE.
