RESOLUTION NO.
93-159
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF FEDERAL WAY, WASHINGTON, RATIFYING THE
FILING OF THE CITY'S NOTICE OF INTENTION TO
ASSUME THE FEDERAL WAY WATER AND SEWER
DISTRICT WITH THE PIERCE COUNTY BOUNDARY
REVIEW BOARD.
WHEREAS, the City Council of the City of Federal Way has
previously passed Ordinance No. 92-151 announcing its intention to
initiate proceedings to assume the Federal Way Water and Sewer
District; and
WHEREAS, upon the City's filing with the King County
Boundary Review Board, the Notice of Intention was held in abeyance
until completion of the SEPA appeal process; and
WHEREAS, the SEPA appeal process is now complete upon the
issuance of an Order by the King County superior Court ordering
that no further action should occur on the District's Superior
Court SEPA appeal until completion of the Boundary Review Board
action, which Order was verbally issued November 24, 1993; and
WHEREAS, approximately 0.2% of the District extends into
pierce County; NOW, THEREFORE,
THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON,
DOES HEREBY RESOLVE AS FOLLOWS:
section 1.
The city Attorney's previous action in filing
Federal Way's Notice of Intention to assume the Federal Way Water
and Sewer District with the pierce County Boundary Review Board, in
furtherance of the purposes of Ordinance 92-151, adopted herein by
reference, is hereby ratified and approved.

Ratification.
Any act consistent with the
authority and prior to the effective date of this resolution is
hereby ratified and affirmed.
section 3.
Effective Date.
This resolution shall be
effective immediately upon passage by the Federal Way city Council.
