Res 94-180 RESOLUTION NO. 94-180 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, ADOPTING INTERIM COMPREHENSIVE PLAN DESIGNATIONS AND AMENDING THE CITY'S OFFICIAL COMPREHENSIVE PLAN MAP EFFECTIVE UPON ANNEXATION OF THE CERTAIN PROPERTY CONSISTING OF APPROXIMATELY 700 ACRES CONTIGUOUS TO THE CITY'S EASTERN BOUNDARY (AMENDS RESOLUTION NO. 90-17). WHEREAS, on April 7, 1994, pursuant to RCW 35A.14.120, Weyerhaeuser Company filed a Notice of Intention to Petition for Annexation to the City of Federal Way of approximately 700 acres, which property is legally described in Exhibit A attached hereto and incorporated by this reference (the "Subject Property"); and WHEREAS, on April 19, 1994, the city of Federal Way, having determined that Weyerhaeuser Company was the record owner of not less than 10% in assessed value of the Subj ect Property, as certified by the City Clerk, and that the Notice of Intention was legally sufficient in all other respects, accepted Weyerhaeuser Company's Notice of Intention, and authorized the preparation of a Petition for Annexation, and preparation of proposed zoning regulations for the Subject Property; and WHEREAS, on April 22, 1994, Weyerhaeuser Company submitted its Petition for Annexation representing at least sixty percent (60%) in assessed valuation of the Subject Property, as certified by the city Clerk; and WHEREAS, it is anticipated that the Subject Property may be annexed by the City; and Res'~4-180, Page 1 COPf WHEREAS, all environmental review required by the State Environmental Policy Act, RCW 43.21C has been completed; and WHEREAS, on June 7, 1994, the City Council and Planning Commission jointly held a public hearing, after public notice as required by law, on the adoption of the proposed pre-annexation zoning regulations and comprehensive plan designations for the Subject Property; and WHEREAS, on July 19, 1994, more than thirty days after the first public hearing as required by Federal Way City Code ("FWCC") section 19-103(b), the City Council held a second. public hearing, after public notice as required by law, on the adoption of the pre- annexation zoning and comprehensive plan designations Subject Property and on the proposed annexation; and for the WHEREAS, the Concomitant Pre-Annexation Zoning Agreements provide that the city will establish an interim classification for the property on the City's Official Comprehensive Plan Map; and WHEREAS, FWCC Section 19-101 provides a process for establishing an Interim Comprehensive Plan designation in the absence of a pre-established comprehensive plan designation; and WHEREAS, the Subject Property is located outside of the City's existing incorporated limits and accordingly, a comprehensive plan designation does not exist for the Subject Property; and WHEREAS, FWCC Section 19-101(a) (2) allows the City Council to elect to retain the comprehensive plan map designation of the Subject Property's former jurisdiction as an Interim Comprehensive Plan; NOW, THEREFORE, Res.#~ Page 2 THE CITY COUNCIL OF THE CITY.OF FEDERAL WAY, WASHINGTON, DOES HEREBY RESOLVE AS FOLLOWS: Section 1. Findinas. The City Council hereby finds that the best interests and general welfare of the City will be served by annexing the Subject Property. The City Council further finds that there is no current comprehensive plan designation for the Subject Property. The City Council adopts the findings of the City's Planning Commission contained in the Planning Commission's Recommendation dated July 12, 1994, on Zoning, Comprehensive Plan and Annexation of the Weyerhaeuser Annexation. Section 2. Establishment of Interim Comprehensive Plan Desianation. Pursuant to the authority set forth in FWCC Section 19-101(a) (2), the City Council hereby elects to retain the comprehensive plan map designation of the Subject Property's former jurisdiction of King County and hereby adopts an Interim Comprehensive Plan Map designation on the City's official comprehensi ve plan map as set forth in Exhibit "B," "Interim Comprehensive Plan Designations," attached hereto and incorporated by this reference. The City hereby adopts by reference the applicable provisions of the Federal Way Community Plan developed by King County and the King County comprehensive plan map designation of Office Park and Urban Residential pursuant to RCW 35.13.180; provided, however, that the Federal Way Comprehensive Plan Policies shall apply to the Subject Property. Section 3. Effective Date of Desianations. The Interim Comprehensive Plan designations provided for in Section 2 hereof Res. # 94-18Q, Page 3 and set forth in Exhibit "B" shall become effective upon the annexation of the Subject Property, Section 4 , Term of Interim Comprehensive Plan Desianation. The Interim Comprehensive Plan designation adopted by the City Council pursuant to Section 2 hereof shall be in place no longer than twelve (12) months unless otherwise provided by ordinance. Section 5. Amendment of Comprehensive Plan Map. Upon annexation of the Subject Property, the Planning Manager is directed to amend the City's Official Comprehensive Plan Map pursuant to FWCC Section 19-100 (a) to provide for the Interim Comprehensive Plan designations depicted on Exhibit B. Section 6. Environmental Policv. The City hereby designates this Resolution as a basis for the City's exercise of authority under FWCC Section 18-122 and under the State Environmental Policy Act, and by this reference incorporates this Resolution within the provisions enumerated at FWCC 18-122(d). Section 7. Severability. If any section, sentence, clause or phrase of this resolution should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this resolution. Section 8. Ratification. Any act consistent with the authority and prior to the effective date of the resolution is hereby ratified and affirmed. Res.~4-180, Page 4 Section 9. Effective Date.
