RESOLUTION NO. 95-205
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF FEDERAL WAY, WASHINGTON, OPPOSING THE
SHIPMENT OF SPENT NUCLEAR MATERIALS THROUGH
THE PORT OF TACOMA
WHEREAS, the Port of Tacoma is one of ten possible ports
of entry listed in a Department of Energy March 1995 draft
Environmental Impact Statement to receive spent nuclear fuel
shipments and that such shipments would be trucked to nuclear fuel
sites around the country; and
WHEREAS, the draft Environmental Impact Statement is
inadequate in several respects, including that it fails to
adequately address security issues at the port and in transit, it
fails to adequately identify emergency response in the event of a
catastrophic mishap and it fails to adequately address the socio-
economic impacts associated with the stigma of being within the
proximity of a port of entry of spent nuclear wastes,
WHEREAS, the City of Federal Way is a major municipality
of 73,500 persons located only one mile from the Port of Tacoma;
and
WHEREAS, the stigma and inherent risk of having the Port
of Tacoma as a port of entry for the shipment of spelzt nuclear �-
materials would throw a pall over the entire area around the por�t,
including Federal Way; NOW, THEREFORE, -

THE CITY COUNCIL OF THE CITY OF FEDERAL WAY HEREBY
RESOLVES AS FOLLOWS:
Section 1. Statement of Opbosition. The Federal Way
City Council strongly opposes the shipment of spent nuclear
materials through the Port of Tacoma and encourages the Department
of Energy to choose a more suitable site to receive these
shipments.
Section 2. Severabilitv. If any section, sentence,
clause or phrase of this resolution should be held to be invalid or
unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect tMe validity or
constitutionality of any other section, sentence, clause or phrase
of this resolution.
Section 3. Ratification. Any act consistent with the
authority and prior to the effective date of the resolution is
hereby ratified and affirmed.
Section 4. Effective Date This resolution shall be
effective immediately upon passage by the Federal Way City Council.

Dear Mr. Head:
Thank you for the opporlunity to comment on the Draft Environmental Impact Statement (DEIS) oa the
proposed Nuclear Weapons Proliferation Policy Conceming Foreign Research Reactor Spent Nuclear Fuel.
The City of Federal Way is a municipality of 73,500 persons north of and adjacent to the City of Tacoma.
Our municipal boundary is only one mile from the Port of Tacoma. Our review of the DEIS leads us to the
conclusion that the review is inadequate in several respects:
1. The DEIS fails to adequately addresses security issues at the port and in transit. What
measures aze provided to adequately secure the spent fuels from a hostile attempt to steal or
pirate the casks while in transit on ship, rail or truck?
2. The DEIS fails to adequately identify emergency response in the event of a catastrophic
mishap. What agency and resources would respond? What is the plan of action? Who is
responsible for training?
3. The DEIS fails to adequately address the socio-economic factors that would be associate�i with
the stigma of being a port for the transport of spent nuclear fuel. What costs would there be
associate� with lack of future business to the Port of Tacoma and the City of Tacoma by those
choosing to do business elsewhere because of this issue?
Without a complete and detailed analysis addressing these issues it would appear that the DEIS is inadequate.

around the country. The Port. of Tacoma and the City of Tacoma are opposed, based on security, safety, image and
socio-economic issues. Staff attended a May 22, 1995 Fact F'inding/Public Comment meeting. Public hearings by
DOE are scheduled for May 2A and Jw►e 19, 1995. Staff prepared and sent a comments letter (dated May 26, 1995�
on the Draft Environmental Lnpact Statement. Attached is a Resolution opposing the shipment of spent nudear
materials through the Port of Tacoma.
