Res 96-223 .. RESOLUTION NO. 96-223 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, APPROVING AN ADDENDUM TO THE SOLID WASTE INTERLOCAL AGREEMENT AND -FORUM INTERLOCAL AGREEMENT. WHEREAS, the City of Federal Way and King County (hereafter "the city" and "the County", respectively), have entered into a Solid Waste Interlocal Agreement and a Forum Interlocal Agreement (hereafter, "the Agreements") in which the respective responsibilities of the City and the County for solid waste management have been designated; and WHEREAS, the Agreements have established the existence of a Solid Waste Forum (hereafter, "the Forum") composed of representatives from the County and all municipal corporations located within the boundaries of King County to consider issues of policy regarding the terms and conditions of the Solid Waste Interlocal Agreement; and WHEREAS, since the date of the execution of the Agreements, the Regional Governance summit of elected officials representing' the County and cities located within King County proposed, and the voters adopted, King County Charter amendments which established a minimum of three (3) regional policy committees of the King County Council; and WHEREAS, these committees, which were modeled after the Solid Waste Interlocal Forum, are comprised of six (6) Res. # 96-223, Page # ~ CC~f1f. representatives of suburban cities and Seattle as well as King Councilmembers; and WHEREAS, one of the three, the Regional Policy Committee, has been deemed to meet the characteristics of membership, staffing and relationships to the parties to the Agreements which were intended for the Forum; and WHEREAS, by motion #9297, the King county Council has expressed its intent that the Regional Policy Committee of the King County Council be designated as the successor to the Solid Waste Interlocal Forum and serve the purposes of the Forum described in the Agreements; and WHEREAS, this intent was also expressed by the Suburban cities in Resolution 1, adopted by the Suburban cities Association on June 16, 1993f NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, DOES HEREBY RESOLVE AS FOLLOWS: section 1. Addendum Authorized. The Mayor or his designated representative is authorized and directed to execute such agreements with King County as are necessary to amend the Solid Waste Interlocal Agreement and the Forum Interlocal Agreement in order to designate the Regional Policy Committee of the King County Council as the designated Forum, pursuant to those Agreements. Section 2. Ratification. Any act consistent with the authority and prior to the effective date of this resolution is hereby ratified and affirmed. Res. # 96-224 Page # ~ section 3. Severabilitv. If any section, sentence, clause or phrase of this resolution should be held to be invalid or unconstitutional by court of jurisdiction, competent a such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this resolution. section 4. Effective Date. This resolution shall be effective immediately upon passage by the Federal Way City Council.
