Res 96-227 RESOLUTION NO. 96-227 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, AMENDING RESOLUTION 93-156, RELATING TO PROCEDURES FOR THE DISPOSAL OF SURPLUS PROPERTY BY ADDING AN ADDITIONAL EXEMPTION RELATING TO TRANSFERS OF SURPLUS PROPERTY TO OTHER GOVERNMENTAL UNITS. WHEREAS, the City Council of the City of Federal Way, Washington, November 16, 1993 passed Resolution 93-156 relating to procedures for the disposal of surplus property; and WHEREAS, section 7 of Resolution 93-156 provides that all surplus city property will be sold by means most advantageous to the City; and WHEREAS, RCW 39.33.010 provides for the transfer of any property, real or personal, on such terms as may be mutually agreed upon by the parties; and WHEREAS, it is the in the overall public interest to make provisions that would allow for the donation of surplus city property to other governmental units; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, DOES HEREBY RESOLVE AS FOLLOWS: Section 1. Amendment. section 10 of Resolution No. 93- 156, which relates to procedures for the disposal of surplus property is amended to read as follows: section 10. certain Properties Exempted. No City property originally acquired for public utility purposes shall be leased, sold or conveyed unless the requirements RES # 96-227 , Page 1 (C(Q)f1r of RCW 39.94.040 have been met. All dispositions of City right-of-way property declared surplus by reason of petition for street vacation shall meet the requirements of city Ordinance 91-107 and RCW 35.79.03, as they now exist or may be hereafter amended. In addition, the provisions of this Resolution do not apply to the following: 1. Unclaimed property disposed of by the City's law enforcement agency pursuant to Chapter 63.32 RCW, as it now exists or may hereafter be amended; 2. Property which has been seized as a result of drug forfeiture laws pursuant to Chapter 69.50 RCW, as it now exists or as it may hereafter be amended. L.. Transfers of real or personal propertv between the citv and the state of Washinqton or other political divisions of the state. as allowed bv RCW 39.33.010. as it now exists or as it mav hereafter be amended: provided. however. that such transfer has first been approved bv the citv Council. section 2. Severabilitv. If any section, sentence, clause or phrase of this resolution should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or RES #96-227 , Page 2 constitutionality of any other section, sentence, clause or phrase of this resolution. section 3. Ratification. Any act consistent with the authority and prior to the effective date of the resolution is hereby ratified and affirmed. section 4. Effective Date.
