Res 96-228 .,~ RESOLUTION NO. 96-228 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, PROVIDING FOR THE TRANSFER OF CERTAIN SURPLUS CITY COMPUTERS TO THE FEDERAL WAY SCHOOL DISTRICT. WHEREAS, the City of Federal Way has adopted a four (4) year schedule for personal computer replacement in order to balance the efficiency gain from the operation of new equipment against the associated cost of replacement; and WHEREAS, the Federal Way School District has, through its representatives, indicated that such retired computers and monitors would be a valuable asset in providing technical instruction in the use of computers; and WHEREAS, education is an important quality of life consideration for economic development in the Federal Way area; and WHEREAS, the City of Federal Way and the Federal Way School District are overlapping taxing districts with substantially the same taxpayers; and WHEREAS, RCW 39.33.010 provides for the transfer of property between political subdivisions of the State on such terms and conditions as may be mutually agreed upon by the proper authorities of the political subdivisions involved; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY HEREBY RESOLVES AS FOLLOWS: Res. #96-228 Page #~ CC~~lf section 1. Transfer Authorized. The City Manager, or his designee, is hereby authorized to arrange for the transfer to the Federal Way School District of such computers, monitors, and other miscellaneous equipment that are surplused from city operation, at no cost to the School District. section 2. Severabilitv. If any section, sentence, clause or phrase of this resolution should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this resolution. section 3. Ratification. Any act consistent with the authority and prior to the effective date of the resolution is hereby ratified and affirmed. section 4. Effective Date.
