Res 96-233 :,,¡¡¡> RESOLUTION NO. 96-233 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY, WASHINGTON, AUTHORIZING APPLICATION FOR FUNDING ASSISTANCE FOR THE DEVELOPMENT OF CELEBRATION PARK AND STREAM STABILIZATION OF THE HYLEBOS CREEK UNDER THE PROPOSED KING COUNTY PARKS, RECREATION AND OPEN SPACE FUTURE FUNDING INITIATIVE WHEREAS, a King County bond issue for Parks, Recreation, and Open Space is anticipated to be presented to the public in September 1996; and WHEREAS, the City Council of the City of Federal Way has approved a "Comprehensive Park, Recreation and Open Space Plan" for the urban area which identifies a community, regional and open space park; and WHEREAS, past inadequate control of stormwater flow increases have damaged the Hylebos Creek, creating an unstable, severely degraded stream channel, requiring stream stabilization to dissipate flow energy, minimize sediment delivery downstream and improve habitat; and WHEREAS, the City Council of the City of Federal Way considers it in the best public interest to develop Celebration Park and to protect the Hylebos Creek from stream degradation; and WHEREAS, on April 16, 1996 the Federal Way City Council unanimously approved a recommendation of its Parks and Recreation Committee to submit Celebration Park and Hylebos Creek stream stabilization for the proposed King County funding initiative; Res. #96-233, Page 1 CC~~l( NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY HEREBY RESOLVES AS FOLLOWS: section 1. Authorization to APPlv for Fundinq. A. That the City Manager is hereby authorized to make formal application to submit Celebration Park development, under the local programs category, and Hylebos Creek stream stabilization, under the urban resources category, on behalf of the City of Federal Way for the proposed King County Parks, Recreation, and Open Space Funding Initiative, which is anticipated to be on the September 1996 ballot. B. That any funding assistance so received be used for the development of Celebration Park and the stabilization of the Hylebos Creek. C. That any property acquired or developed with financial aid through the King county funding initiative be placed in use as an outdoor recreation facility and be retained in such use in perpetuity unless as otherwise provided and agreed by the city Council and the King County Council. section 2. Severability. If any section, sentence, clause or phrase of this resolution should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this resolution. Res. #96-233, Page 2 Section 3. Ratification. Any act consistent with the authority and prior to the effective date of the resolution is hereby ratified and affirmed. section 4. Effective Date. This resolution shall be effective immediately upon passage by the Federal Way City Council.
