AGREEMENTS TO ACCBPT FIINDB.
WHEREAS, cities are charged with providinq and
maintaininq public projects neceesary to maintain and improve the
public health, safety and w�lfare; and
WHEREAS, the financial resources of citie� to provide
these necessary service and improve�ents are li�ited; and
WHEREAS, various state and federal sources have special
funds available to supplement city projects; and
WHEREAS, the City staf� has aqgressively pursued
obtaining these fund� in order to �aximiae the local public
benefits of �hes� funds; and
WIiEREAS, the City Council of the City of Federal Way has
approved the Comprehensive Surface Water Facility Plan, which
includes the West Hylebos Channel Stabilization and �abitat
Improvement project coveriag appsoximately one mile of stream
channel as specified in t1�Q Comprehensive Surface Water Facility
Plan; and
WHEREAS, the West Hylebos Channel Stabiliaation and
Habitat Improvement project includes acquisition and restoration of

a regionally significant stream resource, ensurinq fish passage to
the West Hylebos State Park. The City of Federal Way Surface Water
Management Division will be using the Annual Programs portion of
the Surface Water Manaqement Capital Project Fund to implement this
project during 1998;
WHEREAS, supplemental funding from two competitive grant
funds may be possible, from the Washington State Interaqency
Committee for Outdoor Recreation and the United States
Environmental Protection Agency; and
WHEREAS, the City Council of the City of Federal Way
considers it in the best public interest to seek supplemental
fundinq for the We�t Hylebos Chann�l Stabilization and Habitat
Improvement project;
NOW, THEREFORE, TIiE CITY COUNCIL OF THE CITY OF FEDERAL
WAY, WASHINGTON, DC1ES HEREBY RESOLVE AS FOLLOWS:
Section 1. A�nlication Authorized.
A. That the City Manager be authorized to make formal
application to the Interagency Committee for Outdoor Recxeation for
funding assistance for the West Hylebos Channel Stabilization and
Habitat Improvement project; and to raake formal application to the
United States Environmental Protection Agency Wetland's Grant
Program for funding assistance with the West Hylebos Channel
Stabilization and Habitat Improve��aaaent project.
B. That any fund as�iatance so received be used for the West
Hylebo� Channel Stabilization and �abitat Improvsment project.

C. That this resolution become part of any application for
grant funds from the Interager�cy Committee for Outdoor Recreation
or the Environmental Protection Aqency.
Section 2. Agreements Authorized. For the grant
application� approved in this resolution, the City l�anaqer or hi�
or her desiqnated representative i� authorized and directed to
execute such agreements with the aqer�cie: identified abowe ae are
necessary to accept the grant monies, if any shauld be awarded.

Manager or hi� or her designee is hereby authorized to receive the
yrant monies identified above.
�ection 4. severabilitv. If any section, sentence,
clause or phrase of this resolution should be held to be invalid or
unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or
constitutionality of any other section, sentence, clause or phrase
of this resolution.
sect�on 5 . Ratificatfon. Any act consist�nt with the
authority and prior to the �ffective date of this resolution is
hereby ratified �nd affirmed.
Section 6. Effective Date. This resolution shall be
effective immediately upon pas�age by the Federal Way City Council.
