RESOLUTION NO. 97-261
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
FEDERAL WAY, WASHINGTON, APPROVING, WITH
CONDITIONS, THE FINAL PLAT OF WILDWOOD ESTATES,
FEDERAL WAY FILE NO. SUB90-0004.
WHEREAS, the preliminary plat for Wildwood Estates, City of
Federal
Way
File
No.
SUB90-0004,
was
approved
subject
to
conditions, on September 7, 1993, by Federal Way Resolution No. 93-
150; and
WHEREAS, the applicant submitted the application for final
plat for Wildwood Estates within the required time of receiving
approval for the above-referenced preliminary plat; and
WHEREAS, City of Federal Way Community Development Services
staff, having reviewed the proposed final plat for its conformance
to the conditions of the preliminary plat;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY
HEREBY RESOLVES AS FOLLOWS:
Section 1
Findinqs of Fact.
The Federal Way City
Council makes the following Findings of Fact:
1.
The
final
plat
for Wildwood
Estates,
City
of
Federal Way File No. SUB90-0004; is in substantial
conformance
to
the preliminary plat
and
is
in
conformance with applicable zoning ordinances or
other land use controls in effect at the time of
submittal of the complete application.

2.
All conditions as contained in Resolution No. 93-
150 have been satisfied, and/or satisfaction of the
conditions have been sufficiently guaranteed by the
applicant.
3.
Ninety
five
percent
(95%)
of
all
required
improvements have been made and sufficient bond,
assignment of funds,
or other security have been
accepted by the City of Federal Way as financial
guaranty
for
completion
of
all
required
plat
improvements.
4.
All
taxes and assessments owing on the property
being subdivided have been paid.
5.
The
findings,
conclusions,
recommendations,
and
decisions
of
the
Federal
Way
Hearing
Examiner
contained in his reports and recommendations to the
King County Council, dated October 6, 1992, November
4, 1992, January 13, 1993, and May 19, 1993, copies
of which are attached hereto and hereby incorporated
in full by this reference.
Section 2
ADproval.
Based upon the above Findings of
Fact,
the final plat of Wildwood Estates,
Federal Way File No.
SUB90-0004, is approved, subject to satisfaction of the following:
A.
The conditions and recommendations contained in the
Federal Way City Council Resolution No. 93-150, a copy of which is
attached hereto and hereby incorporated in full by this reference;
and

B.
The following additional conditions adopted by the
City Council at the time of preliminary plat approval:
i.
The applicant will be required to submit an
appraisal of similarly situated property so that the City may
determine the exact "fee in lieu of" to satisfy the open space
requirement.
Payment of the fee shall be required prior to final
plat approval.
ii.
Storm drainage detention facilities shall be
designed in accordance with Basin wide recommendation BW-2 of the
Hylebos Creek Lower Puget Sound Basin Plan utilizing the 2-year and
la-year, 7-day storm events instead of the 2-year and la-year 24-
hour storm events in the King County Surface Water Design Manual.
The 30 percent factor of safety shall be applied per the Manual.
iii.
Upon installation of the retention/detention
facility in Tract A, the grading and vegetation and improvements
shall be installed to provide maximum sight distance perpetually.
iv.
Driveways on Lots 6 and 7 shall be placed in
the northernmost location on each lot consistent with FWCC.
C.
The following conditions are hereby adopted and
deemed necessary to provide for adequate storm water drainage from
the site:
i.
The 100-year 7-day water surface elevation
within the closed depression be set at an elevation of 271.00 and
placed on the face of the final plat.
Note that this assumes zero
infiltration which is a conservative assumption.

ii.
Finished Floor/Low Sill elevations be set at a
minimum of 272.00, and placed on the face of the final plat.
Note
that
this
automatically
dictates
a
maximum building
depth
approximately 40-feet.
iii.
The drainage release covenant assoëiated with
the closed depression be revised from the design width of 53-feet
to 60-feet, and that this condition be placed on the face of the
final plat.
iv.
The sediment
in the bot tom of
the closed
depression be removed and as much of the original infiltrative
capacity as possible be recovered.
This may include work to
enhance the capacity.
v.
An overflow slot be installed in the berm to the
north at an elevation of 271.31, sufficient to pass extreme flows
in excess of the 100-year 7-day storm.
D.
A 20-foot wide landscape buffer shall be placed on
the eastern boundary of Lots 1-7 consistent with FWCC.
Section 3
Recording.
The approved and signed final
plat,
together with all legal instruments pertaining thereto as
required pursuant to all applicable codes, shall be recorded by the
applicant in the King County Department of Records.
All recording
fees shall be paid by the applicant.
Section 4
Severability.
If any section,
sentence,
clause or phrase of this resolution should be held to be invalid or
unconstitutional
by
a
court
of
competent
jurisdiction,
such
invalidity or unconstitutionality shall not affect the validity or

constitutionality of any other section, sentence, clause or phrase
of this resolution.
Section S
Ratification.
Any act consistent with the
authority and prior to the effective date of the resolution is
hereby ratified and affirmed.
Section 6
Effective Date.
This resolution shall be
effective immediately upon passage by the Federal Way City Council.
