RESOLUTION NO.
97-263
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
FEDERAL WAY, WASHINGTON, APPROVING SUBMISSION OF
PETITION FOR EXCLUSION AND/OR WITHDRAWAL OF THE
CITY OF FEDERAL WAY FROM THE KING CONSERVATION
DISTRICT.
WHEREAS,
the King County Council
is
considering an
increase in the assessment on properties within the City of Federal
Way (from $1.25 per parcel to $5.00 per parcel), to fund King
Conservation District;
WHEREAS, the City, by letter dated October 28, 1997 from
Mayor Mahlon S. Priest to Larry Phillips, Chair of the King County
Council Regional Water Quality Committee, requested that the County
not increase the assessment but instead explore an alternative
source of funding; and
WHEREAS,
the City, by the same letter,
informed King
County that, should the County opt to increase the assessment, the
City
would
exercise
it
option
to
withdraw
from
the
King
Conservation District; and
WHEREAS,
notwithstanding the lette'r,
King County has
indicated that it will proceed to increase the assessment;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL
WAY HEREBY RESOLVES AS FOLLOWS:
Section 1.
Withdrawal Authorized.
The City Manager is
hereby authorized to sign and file
forthwith a petition,
in

substantially the form attached hereto, for exclusion of the City
of Federal Way from the King Conservation District.
The City
Manager, the City Attorney, and their designees are also authorized
to take all
steps necessary to achieve the exclusion and/or
withdrawal of the City of Federal Way from the King Co~servation
District and to carry out the intent of this resolution.
Such
steps may include,
but not be limited to,
the filing of any
necessary documents with the King Conservation District,
the
Washington State Conservation Commission, the King County Superior
Court, or any other jurisdiction, agency, board, or
court.
Section 2.
Severability.
If any section,
sentence,
clause or phrase of this resolution should be held to be invalid or
unconstitutional
by
a
court
of
competent
jurisdiction,
such
invalidity or unconstitutionality shall not affect the validity or
constitutionality of any other section, sentence, clause or phrase
of this resolution.
Section 3.
Ratification.
Any act consistent with the
authority and prior to the effective date of the resolution is
hereby ratified and affirmed.
Section 4
Effecti ve Date.
This resolution shall be
effective immediately upon passage by the Federal Way City Council.
