A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF FEDERAL WAY, WASHINGTON, AUTHORIZING THE
PUBLIC WORKS DIRECTOR TO APPLY FOR FUNDING
NECESSARY FOR THE REPAIR AND RESTORATION OF
PUBLIC FACILITIES DAMAGED DURING THE WINTER
STORMS OF 1996 - 1997
WHEREAS,
the City of Federal Way (the "City") sustained
storm damage during December 1996, January and February 1997; and
WHEREAS, Federal disaster relief funding is provided by
the
Federal
Emergency
Management
Agency
(" FEMA")
and
is
administered by the State of Washington Military Department (the
"Department"); and
WHEREAS,
under
the
authority
of
Presidential
Major
Disaster Declaration FEMA 1159-DR-WA, the Department has authority
to reimburse the City for those eligible costs and acti vi ties
necessary for the repair and restoration of public facilities
damaged during the period of December 26, 1996 through February 10,
1997;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL
WAY HEREBY RESOLVES AS FOLLOWS:
Section 1.
DesiGnation and Authorization.
The Public
Works
Director is hereby designated as
the City's authorized
representative for obtaining federal and/or emergency or disaster
,
assistance funds and is hereby authorized to execute applications
for reimbursement of all eligible costs incurred in repairing and

restoring public facilities damaged between December 26, 1996 and
February 10, 1997.
Section 2.
Severability.
If any section,
sentence,
clause or phrase of this resolution should be held to be invalid or
unconstitutional
by
a
court
of
competent
jurisdiction,
such
invalidity or unconstitutionality shall not affect the validity or
constitutionality of any other section, sentence, clause or phrase
of this resolution.
Section 3.
Ratification.
Any act consistent with the
authority and prior to the effective date of the resolution is
hereby ratified and affirmed.
Section 4.
Effective Date.
This resolution shall be
effective immediately upon passage by the Federal Way City Council.
