RESOLUTION NO. 99-300
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FEDERAL WAY,
WASHINGTON, CONFIRMING REPORT OF EXPENSES FOR ABATEMENT OF
DANGEROUS BUILDING, LEVYING A SPECIAL ASSESSMENT FOR SAID
ABATEMENT COSTS AND INTEREST, AND CONFIRMING SPECIAL
ASSESSMENT AND RECORDING OF ASSESSMENT ON ASSESSMENT ROLL.
WHEREAS, pursuant to the Uniform Code for Abatement of Dangerous Buildings
("Uniform Abatement Code"), as adopted in Federal Way City Code Section 5-166, on March 19,
19999 the City of Federal Way caused the abatement of a dangerous building, in the form of one-
half of a double-wide mobile home improperly installed at 28107 - 28'" Avenue South; and
WHEREAS, the abatement was performed by Barry Excavating, Inc., under
contract with the City, at a cost of $9,393.60 plus tax of $887.89;
WHEREAS, following issuance of public notice, a public hearing was held before
the Federal Way City Council on May 18, 1999, to hear and consider any protests or objections
to the amount of the abatement costs; and
WHEREAS, the Council received a staff report from the City's Code Compliance
Officer Martin Nordby, detailing the work performed by Barry Excavating and the expenses
incurred thereby; and
WHEREAS, the Council then heard testimony from Mr. Nordby, and heard and
considered testimony of Anatoliy Tkachuk; and

WHEREAS, pursuant to the Sections 905.3 of the Uniform Abatement Code, the
Council wishes to confirm the abatement expenses as stated in the staff report, and confirm the
assessment roll for the abatement costs;
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF FEDERAL WAY
HEREBY RESOLVES AS FOLLOWS:
Section 1. Confirmation of Re\,ort of Expenses. The Council hereby confirms the
expenses of the abatement, in the amount of $9,393.60 plus tax of $887.89, for a total of
$10,281.49.
Section 2 Imposition of Special Assessment. The abatement expenses, in the total
amount of $10,281.49, shall be and hereby are assessed upon and against the property located at
28107 - 28th Avenue South.
Section 3.
Confirmation of Assessment and Direction to Record Special
Assessment on Assessment Roll. The special assessment in the amount of $10,281.49 is hereby
confirmed. The City Manager or his designees shall immediately cause the special assessment to
be recorded on the assessment roll.
Section 4. Severability. If any section, sentence, clause or phrase of this resolution
should be held to be invalid or unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of any other
section, sentence, clause or phrase of this resolution.
Section 5. Ratification. Any act consistent with the authority and prior to the
effective date of the resolution is hereby ratified and affirmed.

Section 6. Effective Date. This resolution shall be effective immediately upon
passage by the Federal Way City Council.
